STIPULATION AGAINST LIENS
WHEREAS, Richard W, Fry and Kelly j. Fry, of Newville, Cumberland
County, Pennsylvania, is about to execute contemporaneously herewith, a contract with
Wolf Builder's Inc. of 35 Kutz Road, Carlisle, Cumberland County, Pennsylvania, for the
erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN lot or parcel of ground situate in North Newtown
Township, Cumberland County, Pennsylvania being more particularly bounded and
described as follows:
BEGINNING at a point in the center line of Fry Road at the common front
property corner of Lot No.1 and Lot No.5 as shown on the hereinafter mentioned Plan of
Lots; thence along said centerline North 89 degrees 20 minutes 09 seconds West, a
distance of 210.26 feet to a railroad spike; thence continuing along the centerline South
89 degrees 10 minutes 32 seconds West, a distance of 1 01.77feetto a point atthe dividing
line between Lot No.1 and Lot No, 5; thence along said dividing line North 13 degrees
55 minutes 34 seconds West, a distance of 288.82 feet to a point at the dividing line
between lot No.1 and Lot No.5; thence along said dividing line South 89 degrees 49
minutes 17 seconds East, a distance of 312.01 feet to a point at the dividing line between
Lot No, 1 and Lot No.5; thence along said dividing line South 13 degrees 55 minutes 34
seconds East, a distance of 288.82 feet to a point, said point being the Place of
BEGINNING.
CONTAINING 2.000 acres.
BEING Lot No.5 on Minor Subdivision Plan for Robert B. Fry prepared by
Eric L. Diffenbaugh, Professional LandSurveyor dated August 15, 2000 and recorded in the
Cumberland County Recorder of Deeds in Plan Book 82, Page 124.

NOW, the :L ~ day of March, 2001, at the time of and immediately
before the execution of the prinCipal contract, and before any authority has been given by
the said Richard W. Fry and Kelly j. Fry, to the said Wolf Builder's Inc. to commence work
on the said bui Iding, or purchase materials for the same in consideration of the making of
the said contract with Wolf Builder's Inc. and the further consideration of One Dollar, to
Wolf Builder's Inc. paid by Richard W. Fry and Kelly j. Fry, it is agreed that no lien shall
be filed against the building by the contractor, or any sub-contractor, nor by any of the
material men or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such
liens being expressly waived.
