WHEREAS, Edward J Hilton and Dorothy A. Hilton, his wife, Owners, of Mechanicsburg,
Cumberland County, Pennsylvania, are about to execute contemporaneously herewith, a
contract, with Fred riday Builders, Inc., of Mechanicsburg, Cumberland County, Pennsylvania,
for the following services: construction of a single family home on Lot 27, Pinehurst Final
Subdivision Plan Phase V, Hampden Township, Cumberland County, Pennsylvania:
ALL THAT CERTAIN tract ofland situate in Hampden Township, Cumberland county,
Pennsylvania, being Lot No. 27 as shown on the plan entitled Pinehurst Final Subdivision Plan
Phase V, dated January 19, 1998, and recorded in Cumberland County Plan Book 76, Page 112,
more particularly bounded and described as follows:
BEGINNING at an iron pin, lying in a northerly right-of-way line of Sand Pine Court cul-de-sac
(60-foot radius) and being a southerly comer of Lot No. 28; thence along Lot No. 28, North 32
degrees 19 minutes 09 seconds East, 63.43 feet to an iron pin, lying in a southerly line of Lot No.
28; thence along said Lot, North 46 degrees 24 minutes 39 seconds East, 346.16 feet to an iron
pin, being an easterly comer of said lot and a southerly comer of Phase I, Lot 40, and a westerly
comer of Phase I, Lot 43, lands now or formerly ofPamay Development Co., Inc.; thence along
said lot and Lot No. 44, South II degrees 04 minutes 42 seconds East, 248_18 feet to an iron pin,
being a southerly comer of Lot No_ 44, Phase I, lands now or formerly ofPamay Development
Co., Inc., and a northerly comer of Lot No. 45, Phase I, lands now or formerly ofPamay
Development Co., Inc_; thence along said lot and Lot No_ 46, South 22 degrees 31 minutes 03
seconds West, 179.01 feet to an iron pin lying in a westerly line of Phase I, Lot 46, land snow or
formerly ofPamay Development co., Inc., and being an easterly comer of Lot No. 26; thence
along Lot No. 26, North 73 degrees 30 minutes 35 seconds West, 189.79 feet to an iron pin,
being a northerly comer of Lot No. 26 and lying in an easterly line of Sand Pine Court cul-de-sac
(60-foot radius); thence along said right-of-way, along a curve to the left, having a chord bearing
of North 52 degrees 29 minutes 33 seconds West, a chord distance of 103.06 feet, a radius of
60.00 feet, and an arc distance of 123_97 feet to an iron pin, being the place of BEGINNING.

, 2001, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Owners
to the said Contractor to commence the said work, or purchase materials for the same in
consideration of the making of the said contract with Contractor, and the further consideration
of One Dollar, to Contractor paid by Owners, it is agreed that no lien shall be filed against the
property by the Contractor, or any sub-contractor, nor by any of the material men or workmen
or any other person for any labor, or materials purchased, or extra labor or materials purchased
in connection with said work, the right to file such liens being expressly waived.
