WAIVER OF LIENS
WHEREAS, Anthony M. Falvo and Katherine M. Falvo. of Cumberland County, Pernsylvania, entered into a
contract with Kelly Carson Construction, of Cumberland County, Pennsylvania, to provide materials and
perform labor necessary for completion of a residential dwelling situate upon lot of ground located:
131 Simmon Road, Mechanicsbutg, PA 17055, Monroe Township, Cumberland COUllty, PENNSYLVANIA,
as more particularly set fort.h in Exhibit "A" attached hereto.
NOW, TIIEREFORE, it is hereby stipulated and agreed by and betwec,n the said parties. as part of the said
contract and for the con~ideration therein set forth, thalneither the lmdersigJleu contractor, any sub-contractor or
material man, nor any ollIer perSall furnishing labor or materials to the said contractor under this contract shall
file a lien for work done or materials furnished to the said building or any part thereof.
This stipulation is made al1d intended to be med with the County ProthOl1otary within ten (10) days alter date, in
accordal1ce with the requirements afthe Act of Assembly ofPel1l1sylvania. in such case provided.
IN WITNESS WHEREOF, the said parties hereto have herelUlto set their hands and seals this 23rd day of
March,2001.

EXHIBIT "A"
ALL THAT CERTAIN tract of land situate in MONROE TOWNSHIP, Cumberland County, Pennsylvania, bounded and described
pursuant to a survey by Gerrit r Betz, Registered Surveyor, dated September 9, 1972, as follows:
BEGINNING at a point in the center ofL.R 21068, also known as Simmons Road on the dividing lien between Lots Nos. 3 and 4 on
the hereinafter mentioned Plan of Lots; thence by said dividing line, North eighty-four (84) degrees forty-five (45) minutes East, three
hundred seventy-eight and sixty-nine one-hundredths (378.69) feet to a hub; thence by land now or formerly of Woodrow
Pertenbaugh, South forty-nine (49) degrees fifty-six (56) minutes East, three eighteen and forty-two one-hundredths (318.52) feet to
an iron pin; thence by the dividing line between Lots Nos. 2 and 3 on said to a point in the center ofL.R. 21068 aforesaid; thence by
the center of said Road, North three (03) degrees thirty-two (32) minutes West, two twenty-six and ninety-five one-hundredths
(226.95) feet to the place of BEGINNING. CONTAINING 2.44 acres, more or less.
BEING the same premises which Joseph A. Walker and Mary A. Walker, Husband and wife, by Deed dated the 16th day of June,
1988, and recorded at Cumberland County in the Office of the Recorder of Deeds, in and for the County of Cumberland, on the 27th
day of June, 1988, in Record Book K33, Page 745, granted and conveyed unto Anthony M. Falvo and Katherine M. Falvo, his wife.
UNDER AND SUBJECT TO restrictions and conditions as now appear of record.
