Dear Mr. Wilson:
I have made every effort to give you an opportunity to involve
yourself in these divorce proceedings by directing pretrial statements and
holding a pre-hearing conference to review the pretrial staternents on
Decernber 20,2001. You did not file a pretrial staternent nor did you
appear at the conference to discuss the econornic issues raised in the
proceedings. You did return the certification docurnent certifying that
discovery is cornplete which was dated Septernber 18, 2001. You also
signed an affidavit of consent and waiver of notice of intention to request
entry of divorce decree so that the divorce can proceed under Section
3301(c) of the Domestic Relations Code, the mutual consent no-fault
provision of the Divorce Code.
The only econornic c1airn raised by your wife is equitable
distribution of rnarital property and her pretrial staternent, which was
filed in accordance with my direction, has set forth the rnarital assets
which would be addressed in an equitable distribution hearing.
Your participation in trying to resolve the equitable distribution
c1airn of your wife, which involves distributing the marital estate, would
hopefully allow us to corne to sorne resolution of the c1airn instead of
your wife being forced to go to a hearing and requiring rne to rnake

Consequently, I am going to give you one final opportunity before we
have a hearing to come to rny office with your wife and her counsel (you
can also obtain counsel if you wish) to discuss the equitable distribution
claim and the asset issue so we can hopefully try to come to sorne
resolution of this case by agreernent of the parties. However, if you
continue to absent yourself in these proceedings, we will have no choice
but to hold a hearing and to make findings and recornmendations based
solely on your wife's testimony.

Dear Mr. Webber and Mr. Wilson:
Mr. Webber, as counsel for wife, and Mr. Wilson, who is apparently representing
himself, have both indicated that discovery is complete.
A divorce complaint was filed on April 2, 2001, raising grounds for divorce of
irretrievable breakdown ofthe marriage. No economic claims were raised in the
complaint.
On August 21,2001, an amended complaint was filed raising an additional
ground for divorce of indignities and an economic claim for equitable distribution. No
claims have been raised for alimony or counsel fees and expenses.
In accordance with P.R.C.P. 1920.33(b) I am directing Mr. Webber, as counsel
for wife, and Mr. Wilson, who is acting pro se, to each file a pretrial statement on or
before Monday, October 22, 2001. Upon receipt of the pretrial statements, I will
immediately schedule a pre-hearing conference with counsel for wife and Mr. Wilson, if
he remains

Statement of Facts
Plaintiff (hereinafter "Wife") is Charmaine Wilson. She resides at 137 Noble Avenue,
Carlisle, P A 17013. She is 68 years old (DOH 1/27/33).
Defendant (hereinafter "Husband") is Homer D. Wilson. He resides at 6280 Carlisle Pike,
Lot 507, Mechanicsburg, PA 17055, (hereinafterreferred to as the "Marital Residence"). He is 70
years old.
Wife believes that Husband is unemployed. Wife is employed on a part-time basis at
American Legion Post 10 I, Carlisle, P A.
There are no children of the marriage.
Wife moved from the marital residence located at 6280 Carlisle Pike, Lot 57, Mechanicsburg,
PA 17055 on or about March 1, 2001.
Wife filed a Complaint in divorce on April 2, 2001. Wife filed an Amended Complaint in
Divorce on or about August 21, 2001 adding a ground for divorce for indignities as well as a claim
for equitable distribution.

a. Real estate and improvements situate at 529 Burgners Road, Lower Frankford
Township, Cumberland County, P A owned jointly by the parties valued at $40,000.00. It is
encumbered with CitiMortgage in the present amount of$36,116.81 (as of September 1,2001).
b. Ford F-150 pick-up truck (year unknown to Wife) titled in Husband's name and
driven by him. Its value is $3,000.00. It is not encumbered.
c. 1985 Cavalier station wagon titled in Wife's name and driven by her. It is valued at
$200.00. It is not encumbered.
d. Cash at marital residence in Husband's possession. Value unknown.
e. Mobile home located at 6280 Carlisle Pike, Lot 507, Mechanicsburg, P A 17055. The
value is unknown. It is not encumbered.
f. Fair rental value of marital residence. Value unknown.

Wife believes that all household items have been distributed to the satisfaction of both
parties.
10. Marital Debts
There is a mortgage with CitiMortgage that encumbers the martial residence. (See l(i)(a)
above). In addition, Wife has paid $3,792.00 toward the mortgage since March 1,2001 (which
includes insurance and taxes).
11. Proposed Resolution
Wife proposes that she receive the real estate and improvements located at 529 Burgners
Road, Carlisle, P A and will assume responsibility for the CitiMortgage encumbrance. Under this
proposal, she will not seek reimbursement for mortgage, taxes and insurance payments made by her
subsequent to the date of separation. She proposes that Husband retain the mobile home that
constitutes the marital residence She will waive any right to fair rental value of the marital residence
under this proposal. She proposes that each party retain their respective vehicles and bank account.
She proposes that each party be responsible for his or her court costs and attorney fees.

AND NOW, comes Plaintiff, Charmaine Wilson, by and through her attorneys, Richard L.
Webber, Jr., and the LaW Office of Michael J. Hanft, and files the following Complaint in Divorce,
and in support thereof avers as follows:
1. Plaintiff is Charmaine Wilson, who currently resides at 137 Noble Avenue, Carlisle,
Cumberland County, pennsylvania 17013, since March 1,2001.
2. Defendant is Homer D. Wilson, who currently resides at 6280 Carlisle Pike, Lot 507,
Mechanicsburg, Cumberland County, Pennsylvania 17055, since December 1979.
3. Plaintiff and Defendant are sui juris, and both have been bona fide residents of the
Commonwealth of Pennsylvania for a period of more than six (6) months immediately preceding the
filing of this Complaint in Divorce.

4. The parties were married on December 22, 1979 in Mechanicsburg Borough,
Cumberland County, Pennsylvania.
5. The marriage is irretrievably broken.
6. There have been no prior actions of divorce or for annulment between the parties.
7. Plaintiffhas been advised of the availability of counseling, and that the Plaintiff may
have the right to request that the Court require the Parties to participate in counseling.
8. Plaintiff requests that the Court enter a decree of divorce,
WHEREFORE, Plaintiff requests Your Honorable Court to enter a Decree in Divorce,
divorcing the Plaintiff from the Defendant.

12. Plaintiff and Defendant have acquired property, both real and personal during their
marriage from the date of said marriage until the date of their separation.
13. Plaintiff and Defendant have incurred debts and obligations during their marriage
which are subject to equitable distribution.
14. Plaintiff and Defendant have been unable to agree as to an equitable distribution of
said property.
WHEREFORE, Plaintiff respectfully request the Court to equitably distribute the marital
property of the parties and equitably apportion their debts pursuant to 3104 and 3501(a) of the
Divorce Code.

August 21, 2001.
2. The marriage of plaintiff and defendant is irretrievably broken and ninety
days have elapsed from the date of filing and service of the Complaint.
3. I consent to the entry of a final Decree in Divorce after service of notice of
intention to request entry of the Decree.

of my knowledge, information and belief. I understand that false statements herein are

1. I consent to the entry of a final Decree of Divorce without notice.
2. I understand that I may lose rights concerning alimony, division of
property, lawyer's fees or expenses if I do not claim them before a divorce is granted.
3. I understand that I will not be divorced until a Divorce Decree is entered
by the Court and that a copy of the Decree will be sent to me immediately after it is
filed with the Prothonotary.
