COMPLAINT (ASSUMPSIT)
1. PlaintiB; Refinance America, L TD, is a Colorado corporation and service is accepted in
Pennsylvania at the address ofP!aintiff's Pennsylvania counse~ Robert M Rerbstein, 705 Montgomery
Avenue, Narberth, Pennsylvania.
2. Defendant, Susan J. English Burylo, is an individual residing at 731 Torway road,
Czrdners, Cumberland County, Pennsylvania.
3. Defendant accepted a credit card from a credit card issuer, FIRST USA, NA, under
account number 4417 1228 0724 6674, as evidenced by the annexed Acceptance Certificate, a copy of
which is annexed hereto as exhibit "N', with the understanding that use of this credit card account
would be subject to the card holder agreement, a copy of which is attached hereto and marked Exhibit
''B''.
4. On various occasions, from time to time, the credit card issued to Defendant by FIRST
USA, NA was used by Defendant, or others with Defendant's consent, to make purchases of
merchandise or services, which purchases were paid by FIRST USA, NA under it's credit card
program, or to obtain cash advances from FIRST USA, NA

5. Pursuant to the card holder agreement, defendant was indebted to FIRST USA, NA in
the sum of $5,851.93 being the balance due on the credit card as of the date of charge oil:; September
11, 1998.
6. plaintiff further alleges that there was an account stated by operation of law between
FIRST USA, NA and Defendant wherein FIRST USA, NA billed Defendant for the credit card
account balance and received no timely objections to such billing, as per the attached copy of such
billings marked as Exhibit "C".
7. On or about October 10, 1998, FIRST USA, NA assigned the debt for good and
valuable consideration to Plaintiff. A copy of the Certificate of AssignnIent is annexed hereto as
Exhibit "D".
8. Plaintiff is entitled to recover pre-litigation interest as pennitted by the card holder
agreement annexed hereto as Exlnbit ''B''''. Interest is calculated at the annual percentage rate of
12.99"/0 as per the attached billing wherein as to the date of the filing of this Complaint, plaintiff is
entitled to an additioual sum of$I,521.07.
9. As per Exlnbit "B", Plaintiff is entitled to reasonable attorneys fees for the lawful
collection of this debt billed at PlaintifP s previous attorney and PlaintifP s current attorney's nomIal
hourly fee of $175.00 per hour totaling $2,800.00 through the time of the filing of this Common Pleas
Complaint
10. PlaintifPs reasonable attorneys fees continue at PlaintifPs attorney's nomIal hourly fee
of$I75.00 per hour.
11. The Defendant, in accepting the credit card account, did promise to pay said sums
upon demand. Payment has been demanded and has not been l!1lIde.

WHEREFORE, Plaintiff demands judgment against the Defendant in the sum of $1,173.00
plus interest which Plaintiff is entitled to by operation of law together with further reasonable attorneys
fees as permitted by the agreement between the parties, costs of suit, and for such other and further
relief as the Court may deem proper.

card issued by First USA, NA on various occasions until November 1996 when Defendant paid
off the account balance and instructed First USA, NA to close the account to purchases. It is

5. Denied. It is specifically denied that Defendant was indebted to First USA, NA in
the amount of $5,851.93 at the time the account was charged off. By way of further response,
it is denied that Defendant is indebted to the Plaintiff beyond the $242.00 required to pay the
balance at the time Defendant closed the account.
6. Denied. After reasonable investigation, Defendant is without sufficient
knowledge to respond to the veracity of the averments contained in paragraph 6. In the event
any portion of paragraph 6 is deemed factual, it is specifically denied that Defendant received
any statements after November 1996.
7. Denied. After reasonable investigation, Defendant is without sufficient
knowledge to respond to the veracity of the averments contained in paragraph 7.
8. Denied. It is specifically denied that Defendant owes Plaintiff any amount over
the $242.00 required to pay the balance at the time Defendant closed the account.
9. Unknown. Defendant has no personal knowledge of the fee
schedule of Plaintiff's attorney.
10. Denied. After reasonable investigation, Defendant is without sufficient
knowledge to respond to the veracity of the averments contained in paragraph 10.

DEFENDANT'S NEW MATTER
AND NOW COMES, Defendant, Susan J. English Burylo, by and through her attorney,
Peter J. Russo, Esquire, and avers the following:
11. On or about November 6, 1996, Defendant sent a check for $4,800.00 to First
USA, NA along with a letter explaining that it was for payment in full of the balance of her credit
card account, which instructed First USA, NA to close the account from any further purchases.
12. When the $4800.00 payment was remitted to First USA, NA Defendant had
already withdrawn authorization for anyone to utilize the First USA account.
13. After instructing First USA, NA to close her account, Defendant never received a
further statement or communication from First USA, NA until after the account had been
charged off and the company began telephoning her for payment.
14. In accordance with the credit card holder agreement between First USA, NA and
Defendant, Defendant notified First USA, NA as soon as she herself became aware that the
card had been stolen and was being used without authorization.
15. There was a delay in Defendant's knowledge of the theft, because it is believed,
therefore averred, that her mail was stolen along with the card after Defendant closed the
credit card account in November of 1996.
16. During the time from November 1996, until the billing address was changed with
First USA, NA, an individual known as Angie O'Keefe was living in Defendant's home.
17. While Angie O'Keefe had access to Defendant's mail at all times during her
residence in Defendant's home, she was never authorized to utilize her First USA card.

18. When Angie O'Keefe moved from Defendant's residence, the address on the
credit card account was changed.
19. After reasonable investigation, Defendant has learned that the new address
given to First USA, NA was the new address being utilized by Angie O'Keefe.
20. Defendant has reviewed the statements attached to Plaintiff's complaint and
avers that she has not utilized the card at any of the establishments indicated on the credit
card statements on the days indicated.
21. Defendant believes and avers that Angie 0' Keefe stole Defendant's credit card
and Defendant's credit card statements.
22. Any use of the card after November 1996 was clearly unauthorized.
23. Any use of the credit card after November 1996 was fraudulent.
24. Pursuant to 9103 (0) of the Truth in Lending Act, card holder liability is
specifically limited to $50 for charges made by third parties that are "unauthorized."
25. Pursuant to 9103 (0) of the Truth in Lending Act "unauthorized use" is defined as
"use of the card by person other than the card holder who does not have actual, implied or
apparent authority for such use and from which holder receives no benefit."
26. Any use of the card after November 1996 was the result of the theft of both the
credit card and Defendant's mail. The Truth in Lending Act clearly "precludes finding of
apparent authority when transfer of card was without holder's consent as in cases involving
theft, loss or fraud.
27. Plaintiff has failed to set a claim upon which release may be granted.

29. Plaintiff may be barred in whole or in part by the applicable Statute of
Limitations.
30. Plaintiff may be barred in whole or in part by the principle of res judicata.

32. Plaintiff's claim may be barred by the Principles of Accord and Satisfaction.
33. Plaintiff's claim may be barred by the doctrine of payment.
34. Plaintiff voluntarily assumed the risk of the facts set forth in this Complaint
and accordingly his claim is barred.
35. Plaintiff's claim may be barred and limited by the doctrines of comparative
negligence and/or assumption of the risk.
36. No conduct of the Defendant or agent of the Answering Defendant resulted in
or is the proximate cause of any injury or damage sustained by the Plaintiff.
37. Any injuries and/or damages claimed by the Plaintiff, if proven, were caused
by persons other than Answering Defendant and not within the control of Answering
Defendant.
38. At all material times hereto Answering Defendant acted reasonably,
appropriately and caused no injuries or damage to Plaintiff.
39. Any harm suffered by the Plaintiff arose out of their own non-performance of
the essential obligations.

obligations, By way of further answer, plaintiff avers a) the check and
letter were sent to the wrong address, b) the defendant failed to return
the credit cards, c) there remains an acknowledged balance, and d) the card
was used after application of this payment.

guidelines for the withdrawal of authorization. Defendant never received
confirmation from First USA that the account was deemed closed, and defendant
failed to follow-up her alleged request to close the account.

her address as required by the Card Holder Agreement.

1. On March 5, 2002, the Honorable Kevin A. Hess, issued a Rule upon the Defendant to
