MOTION FOR WRIT OF SEIZURE PURSUANT TO PA.R.C.P.1075.1
AND NOW COMES plaintiff, Toyota Motor Credit Corporation, by and through its
attorneys, Kantrowitz & Phillippi, LLC, and under and pursuant to the provisions of Rule
1075.1 of the Pennsylvania Rules of Civil Procedure, moves for a Writ of Seizure and in
support thereof sets forth the following:
1. Plaintiff instituted this action in replevin against the defendant at the above-
captioned term and number, seeking to recover possession of the below-listed property:
2000 Toyota Avalon, VIN #4T51 BF28B6YU1 02170.
2. The plaintiff wishes to proceed under and pursuant to the applicable
provisions of the Pennsylvania Rules of Civil Procedure with respect to an action in replevin
to have the Sheriff of Cumberland County, Pennsylvania, take possession of the subject
property provided the plaintiff establishes a right to take possession and no counterbond

, 1998, upon consideration of plaintiff's
Motion for Writ of Seizure Pursuant to Pa.R.C.P. 1075.1, it is hereby ORDERED and
DECREED that plaintiff's Motion is GRANTED, and, conditioned upon the posting of a bond
as hereinafter provided, the Prothonotary is directed to issue a Writ of Seizure to the Sheriff
of Cumberland County commanding him to take possession of one 2000 Toyota Avalon,
within ten (10) days. The Sheriff shall deliver the vehicle to Plaintiff in accordance with
Pa.R.C.P.1077(b).
It is further ORDERED and DECREED that plaintiff post a bond in accordance with
Pa.R.CP. 1075.3(d) in the amount of_.
It is further ORDERED and DECREED that defendant, James Creed, advise Toyota
Motor Credit Corporation of the location of the vehicle within ten (10) days or risk civil

actually received by defendant, notwithstanding a reasonable attempt to give notice, the

3. On information and belief, at the present time, there is located within
Cumberland County the subject property to which plaintiff is entitled by virtue of the
wrongful acts of defendant as set forth in the Complaint, a copy of which is attached hereto
and incorporated herein and marked as Exhibit "A."
4. The plaintiff is seeking the issuance of a Writ of Seizure by virtue of the fact
that defendant is unlawfully possessing the vehicle to which is the property of plaintiff and
to which is entitled to possession pursuant to the Lease. A copy of the Lease Agreement
is attached to the Complaint as Exhibit "A."
5. Defendant has refused to give plaintiff possession of the vehicle despite
requests to do so. Defendant has no right to retain the vehicle as plaintiff has not
authorized same.
6. Due to the nature of the collateral, plaintiff believes:
a. that the value of the property and plaintiff's interest therein will be
adversely effected by the continued possession by the defendant;
b. the defendant will continue to retain and refuse to return the property;
and
c. if defendant uses the vehicle, he may damage it, causing irreparable
harm to the plaintiff.
WHEREFORE, plaintiff, Toyota Motor Credit Corporation, requests this Honorable
Court to issue a Writ of Seizure directing defendant to disclose the whereabouts of the
vehicle and directing the Sheriff of Cumberland County, Pennsylvania, to take into
possession the subject vehicle set forth more particularly in paragraph (1) of this Motion

and deliver said property to the plaintiff in the following manner:
a. the Sheriff, or his deputy, will serve the Writ of Seizure within ten (10)
days upon the defendant or any other person not a party who is found

MEMORANDUM OF LAW IN SUPPORT OF PLAINTIFF'S, TOYOTA
MOTOR CREDIT CORPORATION, MOTION FOR WRIT OF SEIZURE
NOW COMES, plaintiff, Toyota Motor Credit Corporation and in support of its Motion
for Writ of Seizure submits for this Court's consideration the following memorandum of law.
I. FACTS:
Plaintiff, Toyota Motor Credit Corporation, instituted this action in replevin against
the defendant, James Creed, at the above-captioned term and number, seeking to recover
possession of a 2000 Toyota Avalon, VIN #4T1 BF28B6YU1 02170, Defendant, James
Creed, as lessee, entered into a Lease for the subject vehicle, (a copy of the Lease is
attached to the Complaint as Exhibit "A"). The agreement was assigned to plaintiff, Toyota
Motor Credit Corporation. Defendant, failed to make payments in accordance with the
Lease. Therefore, pursuant to the terms of the Lease, defendant, is in default and Toyota
Motor Credit Corp. is entitled to possession of the vehicle.

Plaintiff, Toyota Motor Credit Corporation made several demands for return of the
vehicle to defendant. To date, all demands for the return of the subject vehicle have been
refused or ignored. Toyota Motor Credit Corporation now wishes to proceed under and
pursuant to the applicable provisions of the Pennsylvania Rules of Civil Procedure with
respect to an action in replevin to have the Sheriff of Cumberland County, Pennsylvania,
take possession of the subject property. In order to obtain rightful possession of the
subject vehicle, plaintiff, Toyota Motor Credit Corporation, has filed the within Complaint
in Replevin and Motion for Writ of Seizure pursuant to Pa. R.C.P. 1075.1. (A copy of these
pleadings are attached hereto as Exhibit "A").

NOW COMES plaintiff, Toyota Motor Credit Corporation, by and through its

into a Lease Agreement for the lease of a 2000 Toyota Avalon, VIN
#4T1 BF28B6YU 1 02170. (A copy of the Lease Agreement is attached hereto as Exhibit
"A.II)
4. The agreement was assigned to Toyota Motor Credit Corporation.

5. Pursuant to the terms of the Lease, Defendant, James Creed, is in default for

6. Several demands for return of the vehicle were made by Toyota Motor Credit
Corporation.
7. The aforementioned demands for return ofthe vehicle have been refused or

8. Pursuant to its status as owner, Toyota Motor Credit Corporation is entitled
to possession of the vehicle.
9. While the vehicle remains in the possession of the Defendant, it loses value
and is subject to damage by Defendant.
12. If Defendant or another person were to damage the vehicle, Toyota Motor
Credit Corporation could suffer irreparable harm.
13. At the present time the wholesale value ofthe vehicle is as follows:
$22,850.00.
The Affidavit of Beth O'Shaughnessy is attached hereto as Exhibit "B".
14. On information and belief, the vehicle is located within Cumberland County.
WHEREFORE, Plaintiff, Toyota Motor Credit Corporation, requests entry of:
1. A judgment that plaintiff is entitled to possession of the vehicle; and

AND NOW COMES plaintiff, Toyota Motor Credit Corporation, by and through its
attorneys, Kantrowitz & Phillippi, LLC, and under and pursuant to the provisions of Rule
1075.1 of the Pennsylvania Rules of Civil Procedure, moves for a Writ of Seizure and in
support thereof sets forth the following:
1. Plaintiff instituted this action in replevin against the defendant at the above-
captioned term and number, seeking to recover possession of the below-listed property:

provisions of the Pennsylvania Rules of Civil Procedure with respect to an action in replevin

3. On information and belief, at the present time, there is located within
Cumberland County the subject property to which plaintiff is entitled by virtue of the
wrongful acts of defendant as set forth in the Complaint, a copy of which is attached hereto
and incorporated herein and marked as Exhibit "A."
4. The plaintiff is seeking the issuance of a Writ of Seizure by virtue of the fact
that defendant is unlawfully possessing the vehicle to which is the property of plaintiff and
to which is entitled to possession pursuant to the Lease. A copy of the Lease Agreement
is attached to the Complaint as Exhibit "A."
5. Defendant has refused to give plaintiff possession of the vehicle despite
requests to do so. Defendant has no right to retain the vehicle as plaintiff has not
authorized same.
6. Due to the nature of the collateral, plaintiff believes:
a. that the value of the property and plaintiff's interest therein will be
adversely effected by the continued possession by the defendant;
b. the defendant will continue to retain and refuse to return the property;
and
c. if defendant uses the vehicle, he may damage it, causing irreparable
harm to the plaintiff.
WHEREFORE, plaintiff, Toyota Motor Credit Corporation, requests this Honorable
Court to issue a Writ of Seizure directing defendant to disclose the whereabouts of the
vehicle and directing the Sheriff of Cumberland County, Pennsylvania, to take into
possession the subject vehicle set forth more particularly in paragraph (1) of this Motion

NOW COMES, plaintiff, Toyota Motor Credit Corporation and in support of its Motion
for Writ of Seizure submits for this Court's consideration the fOllowing memorandum of law.
t. FACTS:
Plaintiff, Toyota Motor Credit Corporation, instituted this action in replevin against
the defendant, James Creed, at the above-captioned term and number, seeking to recover
possession of a 2000 Toyota Avalon, VIN #4T1BF28B6YU102170, Defendant, James
Creed, as lessee, entered into a Lease for the subject vehicle, (a copy of the Lease is
attached to the Complaint as Exhibit "A"). The agreement was assigned to plaintiff, Toyota
Motor Credit Corporation. Defendant, failed to make payments in accordance with the
Lease. Therefore, pursuant to the terms of the Lease, defendant, is in default and Toyota
Motor Credit Corp. is entitled to possession of the vehicle.

Plaintiff, Toyota Motor Credit Corporation made several demands for return of the
vehicle to defendant. To date, all demands for the return of the subject vehicle have been
refused or ignored. Toyota Motor Credit Corporation now wishes to proceed under and
pursuant to the applicable provisions of the Pennsylvania Rules of Civil Procedure with
respect to an action in replevin to have the Sheriff of Cumberland County, Pennsylvania,
take possession of the subject property. In order to obtain rightful possession of the
subject vehicle, plaintiff, Toyota Motor Credit Corporation, has filed the within Complaint
in Replevin and Motion for Writ of Seizure pursuant to Pa. R.C.P. 1075.1. (A copy ofthese

COMPLAINT IN REPLEVIN
NOW COMES plaintiff, Toyota Motor Credit Corporation, by and through its
attorneys, Kantrowitz & Phillippi, LLC, and brings this action in replevin against defendant,
James Creed, of which the following is a statement:
1. Plaintiff, Toyota Motor Credit Corporation, is a corporation with an address
at One Parkway North, Suite 300, P.O. Box 915, Deerfield, IL 60015.
2. Defendant, James Creed, is an individual with an address at 2 Laurel Drive,
Enola, PA 17025-1513.
3. On or about August 4, 2000, Defendant, James Creed, as lessee, entered
into a Lease Agreement for the lease of a 2000 Toyota Avalon, VIN
#4T1 BF28B6YU102170. (A copy of the Lease Agreement is attached hereto as Exhibit
IIA.")
4. The agreement was assigned to Toyota Motor Credit Corporation.

5. Pursuant to the terms of the lease, Defendant, James Creed, is in default for
failure to make payments.
6. Several demands for return of the vehicle were made by Toyota Motor Credit
Corporation.
7. The aforementioned demands for return of the vehicle have been refused or
ignored.
8. Pursuant to its status as owner, Toyota Motor Credit Corporation is entitled
to possession of the vehicle.
9. While the vehicle remains in the possession of the Defendant, it loses value
and is subject to damage by Defendant.
12. If Defendant or another person were to damage the vehicle, Toyota Motor
Credit Corporation could suffer irreparable harm.
13. At the present time the wholesale value of the vehicle is as follows:
$22,850.00.
The Affidavit of Beth O'Shaughnessy is attached hereto as Exhibit "B".
14. On information and belief, the vehicle is located within Cumberland County.
WHEREFORE, Plaintiff, Toyota Motor Credit Corporation, requests entry of:
1. A judgment that plaintiff is entitled to possession of the vehicle; and
2. The cost of this action together with reasonable attorney's fees.

COMPLAINT IN REPLEVIN
NOW COMES plaintiff, Toyota Motor Credit Corporation, by and through its
attorneys, Kantrowitz & Phillippi, LLC, and brings this action in replevin against defendant,
James Creed, of which the following is a statement:
1. Plaintiff, Toyota Motor Credit Corporation, is a corporation with an address
at One Parkway North, Suite 300, P.O. Box 915, Deerfield, IL 60015.
2. Defendant, James Creed, is an individual with an address at 2 Laurel Drive,
Enola, PA 17025-1513.
3. On or about August 4, 2000, Defendant, James Creed, as lessee, entered
into a Lease Agreement for the lease of a 2000 Toyota Avalon, VIN
#4T1 BF28B6YU1 02170. (A copy of the Lease Agreement is attached hereto as Exhibit
"A,")
4. The agreement was assigned to Toyota Motor Credit Corporation.

5. Pursuant to the terms of the Lease, Defendant, James Creed, is in default for
failure to make payments.
6. Several demands for return of the vehicle were made by Toyota Motor Credit
Corporation.
7. The aforementioned demands for return of the vehicle have been refused or
ignored.
8. Pursuant to its status as owner, Toyota Motor Credit Corporation is entitled
to possession of the vehicle.
9. While the vehicle remains in the possession of the Defendant, it loses value
and is subject to damage by Defendant.
12. If Defendant or another person were to damage the vehicle, Toyota Motor
Credit Corporation could suffer irreparable harm.
13. At the present time the wholesale value of the vehicle is as follows:
$22,850.00.
The Affidavit of Beth O'Shaughnessy is attached hereto as Exhibit "B".
14. On information and belief, the vehicle is located within Cumberland County.
WHEREFORE, Plaintiff, Toyota Motor Credit Corporation, requests entry of:
1. A judgment that plaintiff is entitled to possession of the vehicle; and
2. The cost of this action together with reasonable attorney's fees.
