HomeMy WebLinkAbout03-1971STIPULATION AGAINST LIENS THIS AGREEMENT made this 5th day of December, 2002 by and between Harvey B. Landis hereinafter referred to as Contractor, THE HOUSING AUTHORITY OF CUMBERLAND COUNTY, hereinafter referred to as Owner, whereby the former undertook and agreed to perform and complete a housing repair project at 230 East Garfield Street in Shippensburg, Cumberland County, PA NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One Dollar ($1.00) to and in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the Agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or othenvise, for, towards, in, or about the erection and construction of the said buildings on the lot above described and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Landis, known to me (or satisfactorily proven) to be the person whose name is subscribed as such, and who acknowledges himself to be the owner_of Harvey B. Landis Building and Remodeling, and as such owner, being authorized to do so, executed the foregoing statement for the purposes therein contained by signing the name of the company by himself as owner. S~L Nota~ Public ACKNOWLEDGMENT FOR CORPORATION STATE OF PENNSYLVANIA COUNTY OF CUMBERLAND On this, the 5th day of December, 2002 before me, a Notary Public, personally appeared Christopher Gulotta, known to me to be the person whose name is subscribed as such, and who acknowledges himself to be the Executive Director of THE HOUSING AUTHORITY OF CUMBERLAND COUNTY, and as such Executive Director, being authorized to do so, executed the foregoing statement for the purposes therein contained by signing the name of THE HOUSING AITHORITY OF CUMBERLAND COUNTY by himself as Executive Director.
