IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO. 2007 -1433 : CIVIL ACTION MOTION TO RELEASE ESCROW FUNDS AND NOW this 23rd day of March, 2007, comes the Plaintiff, GNANACHANDRA CHINNIAH, by and through his attorneys, Irwin & McKnight, and respectfully requests that this Court grant his Motion to Release the Escrow Funds being held in the Prothonotary's Office, and in support thereof aver as follows: 1. Plaintiff commenced this action against Defendant on or about February 20, 2007, by filing a Landlord Tenant Complaint with District Justice Richard S. Dougherty. 2. Plaintiff s Complaint was the third such Complaint filed against Defendant before District Justice Richard S. Dougherty involving the non-payment of rent. 3. On or about March 6, 2007, District Justice Dougherty issued a Notice of Judgment in favor of Plaintiff in the amount $1,222.00 and established the monthly rent in the amount of $750.00. A true and correct copy of Notice of Judgment is attached hereto and incorporated herein as Exhibit "A". 4. On or about March 14, 2007, Defendant filed a Notice of Appeal from District Justice Judgment. 5. Defendant has deposited with the Cumberland County Prothonotary the unpaid portion of the monthly rent and late fees due for the month of February as well as the rent due for L Y March as provided by District Justice Dougherty's decision, but only a portion of the late fees due for the month of March 2007 under the terms of the written lease. 6. Defendant continues to reside at the subject premises. 7. No member of this Honorable Court has previously been involved or issued any prior rulings in this matter. WHEREFORE, Plaintiff, GNANACHANDRA CHINNIAH, respectfully requests that this Honorable Court release the funds held in the escrow account while the appeal is pending in order to compensate Plaintiff for the Defendants use and possession of the premises.
