LORI A. FURRY, Defendant DEFENDANT'S BRIEF IN SUPPORT OF PRELIMINARY OBJECTIONS AND NOW, comes the Defendant, Lori A. Furry, and files this brief in support of Defendant's Preliminary Objections filed pursuant to Pa.R.C.P. No. 1028: A. Factual and Procednral Snmmarv Plaintiff is the landlord for commercial shopping center known as King Street Court. Defendant was a tenant in King Street Court. Defendant was operating a business in King Street Court pursuant to a lease that expired December 8, 1999. Plaintiff alleges that, on or about May 9, 1999, Defendant terminated the lease and vacated the premises prior to the lease expiring. Plaintiff is seeking back rent and damages related to attorney fees and costs. Plaintiff initially filed a complaint in District Justice Court in March 200l. Defendant filed an appeal to the judgment entered by the District Justice Court. Plaintiff s complaint and the below preliminary objections follow. B. Discussion L Defendant objects to paragraph 5 of the Complaint for insufficient specificity. Plaintiffs assert that he examined the premises and found a hole in the wall and a missing interior 8.2.01lJNElBriefin Support ofPrelimanry Objections - Fulton v. The Plaintiff has not alleged when the damage was discovered, the person or person who damaged the property, or, if Defendant is responsible for the damage, that the damage went beyond ordinary wear and tear as contemplated in paragraph 14 of the lease. Pennsylvania is a fact pleading jurisdiction and a pleading must not only appraise the opposing party of the asserted claim, but it must also formulate the issues by sununarizing those facts essential to support the claim. CoreStates Bank. NA v. Cutillo, 723 A.2d 1053 (Pa.Super 1999). Paragraph 5 fails to satisfy Pennsylvania's factual pleading requirements by failing to aver facts regarding the above stated matters. 2. Defendant objects to paragraph 6 of the Complaint for insufficient specificity. Plaintiffs state that the cost of repairing the damage totaled $96.52. However, Plaintiff failed to allege the type of repairs that were performed. Pennsylvania is a fact pleading jurisdiction and a pleading must not only appraise the opposing party of the asserted clairn, but it must also formulate the issues by sUTurnarizing those facts essential to support the claim. CoreStates Bank. N.A. v. Cutillo, 723 A.2d 1053 (Pa.Super 1999). Paragraph 5 fails to satisfy Pennsylvania's factual pleading requirements by failing to aver facts regarding the above stated matters. Furthermore, Defendant requests that paragraph 6 be stricken for failure to attach the receipt for the repairs. Given that Plaintiff is capable of stating his damages so specifically, it is reasonable to infer that the amount was determined from a written receipt. In accordance with Pa.R.C.P. 10l9(i), a pleader must attach a copy of the writing if any part of the claim is based upon a writing. 3. Defendant seeks a demurrer to Plaintiffs paragraph 7 pursuant to Pa.R.c.P. l028(a)(4). Plaintiff states that Defendant vacated the premises without giving proper notice and 1003834-1 2 " I I " ~ , ~, , ~"".,;~;~.-; that she is therefore liable for $4,200.00, which allegedly represents the remaining rent due on the lease term, However, paragraph II of the Lease, entitled "Default", states a mandatory prerequisite for filing a lawsuit for past due rent. Paragraph 11 requires the Plaintiff to first provide Defendant with a written notice of default and a thirty (30) day opportunity to cure the default. According to the Lease, if Defendant fails to cure the default after being served with the written notice of default, "it shall and may be lawful for the [plaintiff] ... to sue for rent" Plaintiff has failed to allege that he satisfied the requirementto first provide written notice and an opportunity to cure, Because he has failed to allege such facts, the Plaintiff's claim must be stricken for legal insufficiency. 4. Defendants seek a demurrer to Plaintiffs paragraph 8 pursuant to Pa.R.C.P. 1028(a)(4), Plaintiff seeks an award of attorney fees. However, before Plaintiff can state a colorable claim for attorney fees he must fust allege facts that will show liability by the Defendant and an entitlement to attorney fees because of the damage. In light of Plaintiff s failure to allege facts showing he met the contractual prerequisites to filing a lawsuit for past due rent, he has failed to allege the necessary facts for finding Defendant liable for damages based on Plaintiff s alleged breach of the lease agreement. Because he has failed to allege such facts, the Plaintiff's claim for attorney fees must be stricken for legal insufficiency. 5. Defendants seek a demurrer to Plaintiffs paragraph 9 pursuant to Pa,RC.P. l028(a)(4). Plaintiff seeks an award for court costs associated with his tiling of a complaint before District Justice Harold Bender, However, before Plaintiff can state a colorable claim for court costs, he must first allege facts that will show liability by the Defendant and an entitlement to court costs because of the damage, In light of Plaintiff's failure to allege facts showing he met 1003834-1 3 - - " ~ -~~ I I ,,'- z_ .:.~"L_"_",: the contractual prerequisites to filing a lawsuit for past due rent, he has failed to allege the necessary facts for finding Defendant liable for damages based on Plaintiffs alleged breach of the lease agreement. Because he has failed to allege such facts, the Plaintiff s claim for court costs must be stricken for legal insufficiency. 6. Defendant seeks a demurrer to the Plaintiffs wherefore clause pursuant to Pa.R.C.P. 1028(a)(4). Plaintiff seeks judgment in the amount of $5,l47A2. Ostensibly Plaintiffs claim is based on past due rent, attorney fees, and court costs. However, before Plaintiff can state a colorable claim for these damages, he must first allege facts that will show liability by the Defendant and an entitlement to damages. In light of Plaintiff s failure to allege facts showing he met the contractual prerequisites to filing a lawsuit for past due rent, he has failed to allege the necessary facts for finding Defendant liable for damages based on Plaintiffs alleged breach of the lease agreement. Because he has failed to allege such facts, the Plaintiff s claim for damages must be stricken for legal insufficiency. In the alternative, Defendant objects to the wherefore clause of the Complaint for insufficient specificity. According to paragraph 12 of the Lease, Plaintiff is required "to utilize reasonable efforts to re-Iet the [premises] and all rents or monies received upon such re-Ietting shall be applied by [Plaintiff] ... to all sums due and owing by [Defendant] to [Plaintift]." Plaintiff has failed to aver the efforts he employed to re-let the premises and to offset any damage allegedly owed by Defendant with rent he recovered by a successor tenant. Accordingly, if the demurrer is not granted, Plaintiff must specify the efforts he employed to re-Iet the premises and the rents, if any, that he recovered from the successor tenant. 1003834-1 4 - I I J i .. FURRY Defendant COMPLAINT AND NOW, comes the plaintiff, BRUCE FULTON tJdIb/a KING STREET COURT, by and through his attorney, Robert B. MacIntyre, and respectfully avers the following: l. Plaintiff is Bruce Fulton tJdIb/a King Street Court, an adult individual who owns and leases commercial real estate, and maintains a primary business address of 204 East King Street, Shippensburg, Cumberland County, Pennsylvania 17257. 2. Defendant is Lori A. Furry, an adult individual whose last known address is 87l West King Street, Shippensburg, Cumberland County, Pennsylvania l7257. 3. On or about December 8, 1998, defendant signed a lease wherein she agreed to rent a portion of commercial property for plaintiff for a period of one year at the cost of $7,200.00 or $600.00 per month. A copy of the lease is attached and marked as Exhibit A. 4. On or about May 9, 1999, defendant vacated the property without proper notice as required by the terms of the lease. Upon examination of the premises, plaintiff found that a hole was cut in a wall for the installation of an air condition and an interior door was removed from the property. 6. The cost of repairing these damages totaled $96.92.. 7. Pursuant to the terms of the lease, defendant's failure to give proper notice prior to the termination of the lease subjects her to liability for the remaining balance, to wit: $4,200.00, a sum representing rents due to the termination of the lease period. 8. According to the terms of the lease, plaintiff is entitled to the award of reasonable attorney fees which, in the instant case, are estimated to be approximately $750.00 9. In pursuing this matter, plaintiff has incurred court costs of$lOO.50 by filing initiating this action before District Justice Harold Bender. WHEREFORE, plaintiff demands judgment in his favor and against defendant in the amount of$5,l47.42. Robert B. After the expiration of the initial term, the parties orally agreed that Defendant would lease the premises on a month-to-month basis. 4. Denied. Furry, demands judgment in her fayor and against Plaintiff. NEW MATTER 10. Plaintiff and Defendant entered into a written lease agreement on or about December 8, 1998, for a term of one year. 11. In or about October 1998, Defendant began to experience water leaks in the leased premises, and she was forced to place buckets to catch the leaking water and was required to work in and around exposed electrical wires. 12. In addition, during the same period oftime, the communal rest room, for which upkeep Plaintiff was responsible, was continually dirty and unkempt. 13. Defendant notified Plaintiff of the conditions described in paragraphs 11 and 12 above on numerous occasions. 14. In early December 1998, upon the expiration of the written lease, Plaintiff and Defendant agreed that Defendant would continue to occupy the leased premises at the same rental on a month-to-month basis. 16. Relying on Plaintiffs oral agreement to continue the lease on a month to month basis, Defendant executed the right to continue lease form presented to her by Plaintiff. 17. Defendant continued to experience problems with water leaks and unsatisfactory maintenance, and in early 1999 informed Plaintiff that she was looking for another business location. At this time Plaintiff indicated that he was unable to fix the roof and that Defendant should "do what she needed to do." 18. On or about April 2, 1999, Defendant notified Plaintiff, pursuant to their oral agreement, that she was terminating the lease effectiye May 1, 1999. Plaintiff did not raise any objections to Defendant terminating the lease until the Spring 2001. 19. Defendant paid all rent due under the written yearly lease and the month-to-month lease. 20. Plaintiffs Complaint fails to state a cause of action upon which relief can be granted under the facts of this case. 21. Plaintiff's claims are barred by the doctrine of unclean hands. 22. Paragraph 11 of the Lease required Plaintiff to provide a written notice of default and an opportunity to cure as a prerequisite to filing a lawsuit for default. Plaintiff failed to give the requisite notice to Defendant prior to filing the instant action. 23. Plaintiffs claims are barred by the doctrine of waiver and release. 24. Plaintiffhadthe duty to maintain the leased premises in a safe and sanitary condition. 25. Plaintiff failed to maintain the premises in a safe and sanitary condition. 3 ~~ ~"- . <. "" 26. If Plaintiff terminated the lease prematurely, which Defendant denies, then such premature termination was the result of Plaintiff's failure to fulfill his obligations under the lease. 27. Assuming arguendo that a default occurred, Plaintiff failed to mitigate his damages as required by Paragraph 12 of the lease and/or deduct any rent recoyered by a successor tenant and credit said rent payments to his claim for damages against Defendant. 28. No attorney fees may be awarded to Plaintiff under the facts and circumstances of this case. 29. No costs may be awarded to Plaintiff under the facts and circumstances of this case. WHEREFORE, Defendant demands judgment in her favor and against Plaintiff. COUNTERCLAIM 30. Counterclaim Plaintiff is the within Defendant, Lori A. Furry. 31.
