Defendant, The American National Red Cross, erroneously referred to as The American Red Cross, for its Notice of Removal states: 1. This state court action is removable under a specific grant of federal jurisdiction in the Red Cross' charter which provides that the Red Cross shall have the "power to sue and be sued in courts of law and equity, state or federal." 36 U.S.C. 9 2. lilfi:'~!,._.. ."','-'0, r",~~"-f'~"',,_, '-'~ -~~ ~~ ~'I' I 'I , . 2. In The American Nat'l Red Cross v. S.G., 505 U.S. 247, 112 S.Ct. 2465,120 L.Ed. 2d 201 (1992), the United States Supreme Court held that the Red Cross charter's "sue and be sued" provision "confers original federal court jurisdiction." 112 S.Ct. at 2466. 3. In S.G. the United States Supreme Court construed the "sue-and-be-sued" provision of the Red Cross charter as conferring "original jurisdiction of federal courts over all cases to which the Red Cross is a party, with the consequence that the oraanization is thereby authorized to removal from state to federal court of any state-law action it is defendina." 112 S.Ct. at 2467 (emphasis added). 4. This notice is being filed within thirty days after the service on the Red Cross of a copy of the Writ of Summons in Robert J. Kater, Plaintiff v. American Red Cross Greater Allegheny Region, et al; No. 01-2882 Civil term, Cumberland County Court of Common Pleas. The notice is being filed pursuant to 28 U.S.C. ~1446(b), which provides for removal within "thirty days after receipt by the defendant, through service or otherwise, of a copy of an amended pleading, motion, order or other paper from which it may first be ascertained that the case is one which is or has become removable." 5. Copies of all process and pleadings served on Defendants are attached as Exhibit "A", as required by 28 U.S.C. ~1446(a); and by this reference are incorporated as part of the Notice of Removal. 6. The Co-Defendant, also represented by undersigned counsel, has consented to and joins in requesting the removal of this case. 7. Although consent is not necessary, Plaintiff consents to the removal of this case, as evidenced by his counsel's signature on the Joinder In and Consent to Removal attached hereto as Exhibit "B" 8. The United States District Court for the Middle District of Pennsylvania is the District Court having jurisdiction over the place where the state court action is pending.
