COMPLAINT
NOW COMES Plaintiff Jennifer Sheriff, by her attorney, Jesse Raymond ROOl, Esquire,
and files the within Complaint as follows:
1. Plaintiff is an adult individual with an address located at 390 Rich Valley Road,
Carlisle, PA 17013,
2. Plaintiff is in the business of providing residential residences for lease.
3, Defendant is an adult individual with an address located at Lot M87, 3450
Mountain Road, Shartlesville P A 19554.
4. Defendant leased the premises from Plaintiff pursuant to a lease agreement, a true
and correct copy of which is attached hereto at Exhibit "A" and incorporated herein by reference,

5, Pursuant to the lease agreement, Defendant was required to use care in
maintaining the welfare and integrity of the premises,
6. Pursuant to the lease agreement, Defendant also agreed to surrender the premises
to Plaintiff at the expiration of the lease agreement in the condition in which the premises were
given to Defendant.
7. Pursuant to the lease agreement, Defendant also agreed to pay for damages she
caused to the premises.
8. Defendant caused damages to the premises in the amount of$5,211.05 because on
January I, 200 I, she failed to maintain heat in the premises.
9, Specifically, because she failed to maintain heat, the water pipes froze in the
apartment, causing the repairs described in Exhibit "B" attached hereto and incorporated herein
by reference.
10. Defendant has failed and or refused to reimburse Plaintifffor these repairs.
II. Failure to reimburse Plaintiff for these repairs was a breach of the lease agreement
for which Plaintiff has been damaged.

ANSWER TO COMPLAINT
This letter is written in order for me to post my objections to the lawsuit.
At the time of this incident, (pipes freezing) there was no lease in eftect. The copy of the lease that is
attached to the packet I received ended in September of2000, also, there is no mention within the lease
regarding the utilities.
At no point in time was I asked to pay for these damages, on the contrary Jen Sheritt: herself informed me
that her insurance had covered the damages. The only thing that she requested of me was an additional
$350.00 insecurity deposit in order for her to cover her deductible, which made a $1000.00 total in security
deposit. Following this incident, at the end of January, 200I, I signed a new lease, and still there was no
request for payment for these damages.
This was not the first time that this has happened. The previous year, beoause of the pipes freezing, I
would have to leave the bathroom mucet run in order to prevent the pipes from freezing. These are plastic
pipes with no insulation in the ceiling. The only pipes that froze in the house was the shower due to lack of
insulation in the ceiling. The neighbor also informed Jen that their pipes froze as well.
Following this incident, I was told I would be out of the apartment for 7 - 10 days to repair the apartment in
which time I signed a new lease, however, after 2 months time, the property still was not fixed. So I was
forced to look for other residence due to the met that the repairs were not made.
Therefore, after all of this, I feel that I do not owe this money.
