HomeMy WebLinkAbout01-5900 -)~ .0/- 5'q o-o STIPULATION AGAINST LIENS THIS AGREEMENT made the 8th day of October ,2001, by and between JS CONSTRUCTION, INC., hereinafter referred to as CONTRACTOR, AND RICHARD AND KAY DOWHOWER, hereinafter referred to as OWNER, whereby the former undertook and agreed to erect and construct a single family dwelling, on that certain lot of ground situate in the Township of Upper Allen, County of Cumberland, Pennsylvania, more particularly known as: 2492 Glime Drive, Lot 102, Mechanicsburg, PA 17055 NOW THEREFORE, this agreement witnesseth: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanics' lien or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Owner EXHIBIT "A" ALL THAT CERTAIN piece or parcel of land situate in Upper Allen Township, Cumberland County, Commonwealth of Pennsylvania, more particularly bounded and fully described as follows: BEGINNING at a point on the eastern right-of-way line of Glime Drive and also being a corner of Lot No. 101; thence along said line, North 15 degrees 22 minutes 11 seconds East, a distance of 63.23 feet to a point on the same; thence along said line with a curve to the right, having a radius of 325.00 feet, an arc length of 43.79 feet, a chord bearing of North 19 degrees 13 minutes 46 seconds East, a chord distance of 43.75 feet to a point on the same; thence along said line with curve to the right, havin~ a radius of 12.00 feet, an arc length of 20.17 feet, a chord bearin~ of North 71 degrees 15 minutes 06 seconds East, a chord distance of 17.88 feet to a point on the southern ri~ht-of-way line of Gregor Court; thence along said line with a curve to the left, havin9 a radius of 1275.00 feet, an arc length of 70.22 feet, a chord bearing of South 62 degrees 09 minutes 50 seconds East, a chord distance of 70.22 feet to a point on the same and a corner of Lot No. 103; thence South 13 de~rees 24 minutes 44 seconds West, a distance of 101.81 feet to a point, bein~ a rear corner of lots No. 101 and No. 103; thence North 74 degrees 37 minutes 49 seconds West, a distance of 89.79 feet to a point on the eastern ri~ht-of-way line of Glime Drive, corner of Lot No. 101 and being the point and place of BEGINNING. CONTAINING 9,628.06 square feet or 0.221 acres. BEING LOT NO. 102 of Ashcombe Farms P.R.D. Phase 3-A recorded in Cumberland County Plan Book 82 Page 125. BEING THE SAME PREMISES which Country Square Partnership, a Pennsylvania General Partnership, by Deed dated May 16, 2001 and recorded June 20, 2001 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 247, Page 131, 9ranted and conveyed unto Richard L. Dowhower and Kay S. Dowhower, husband and wife.
