WHEREAS, AX Ventures, L.L.C., of P.O. Box 474, Dillsburg, PA, is about to execute
contemporaneously herewith, a contract with Pollard & Co., Inc., Contractor, of P.O. Box 66,
Dillsburg, P A 17019, for the erection of a two story residential building upon a lot of land situate
in Upper Allen Township, Cumberland County, more fully described in attached Exhibit "A".
NOW, May 16, 2001, at the time and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to
commence work on the said building, or purchase materials for the same in consideration ofthe
making of the said contract with Owner and the further consideration of One Dollar to
Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the
Contractor, or any sub-contractor, nor by any of the material men or workers or any other person
for any labor, or materials purchased, or extra labor or materials purchased for the erection of
said building, the right to file such liens being expressly waived.

Commonwealth of Pennsylvania< more particulariy bounded and fully described as follows:
BEGINNING at a point on the eastern right-of-way line of Glime Drive and a corner of lot No.1 09.
THENCE along said line with a curve to the left, having a radius of 175.00 feet, an arc length of 65.61
feet, a chord bearing of North 13 degrees 01 minute 48 seconds West, a chord distance of 65.23 feet to a
point on the same and a corner of lot No. 111.
THENCE along the property line with lot No. 111, North 66 degrees 13 minutes 47 seconds East, a
distance of 98.56 feet to a point on the same, also in a 30 feet wide water and sanitary sewer easement
and on the edge line of a 20 feet wide planting easement.
THENCE along said line and within the utilities' easement, South 17 degrees 53 minutes 17 seconds
East, a distance of 104.00 feet to a point on the same and a corner of lot No.1 09.
THENCE along the property line with lot No.1 09, South 87 degrees 42 minutes 37 seconds West, a
distance of 107.52 feet to a point on the same, on the eastern right-of-way line of Glirne Drive, also being
a comer of lot No.1 09 and the point and place of BEGINNiNG.
