(,,Contractor") and BPC partners, lng certain he "Work"), (,,owner") for the purpose of Contractor undertaking and mst comer of improvementS' including all required labor and materials incider :ntified as the upon owner'S premises located at the apprOximatelY I4 acres ~ i the Township the Carlisle pike at Commerce Drive, parcel number '/-459- mia. xNoods Drive Final Subdivision Plan recorded in Plan Book $ of Cumberland, and Comm°nwealt~ of Silver Spring, County .4 TTEST.. ~ue~t NOW, THIS INSTRUMENT WITNESSETH THAT the Contractor, in consideration of the Owner awarding it a contract to complete the Work and $1.00 paid at or before the signing and delivery of this document, for itself and any subcontractor, materialman or anyone else acting through, for or under the Contractor, prior to signing any contract relating to the Work and before any authorization has been given by the Owner to the Contractor to begin the Work or to order or purchase any required materials or supplies therefore, hereby stipulate and agree that no lien or claim for a lien against the said tract of land or improvements about to erected thereon, commonly referred to as a mechanic's lien, shall be filed by anyone, including, without limitation the Contractor, any subcontractor, materialman, or any person furnishing labor or materials in connection with any construction thereon, the right to file such liens being expressly waived. This is a separate and independent covenant and shall be operative and effective with regard to labor done and materials furnished under any supplemental contract or contracts for extra or different work, as well as labor done and materials furnished for the Work under such agreement between the Contractor and the Owner.
