THE FOLLOWING NOTICE IS BEING PROVIDED PURSUANT TO THE FAIR DEBT
COLLECTION PRACTICES ACT, 15 U.S.C. 1601
The undersigued attorney is attempting to collect a debt owed to the Plaintiff, and any
information obtained will be used for that purpose. The amount of the debt is stated in this
Complaint. Plaintiff is the creditor to whom the debt is owed. Unless the Debtor, within thirty
(30) days after your receipt of this notice disputes the validity ofthe aforesaid debt or any
portion thereof owing to the Plaintiff, the undersigued attorney will assume that said debt is
valid. If the Debtor notifies the uudersigued attorney in writing with the said thirty (30) day

COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff, HOMESIDE LENDING, INC., is a Corporation, with an address of 8120 NATIONS WAY,
BUILDING 100, JACKSONVILLE, FLORIDA 32256.
2. Defendant, PAUL D. DANKOWSKY, is an adult individual, whose last known address is 9
WILTSHIRE WEST STREET, CARLISLE, PENNSYLV ANlA 17013. Defendant, MELINDA S.
DANKOWSKY, is an adult individual, whose last known address is 9 WILTSHIRE WEST STREET,
CARLISLE, PENNSYLVANIA 17013.
3. On or about, December 13, 1996, the said Defendants executed and delivered a Mortgage Note in the
sum of $102,100.00 payable to HOMESIDE LENDING, INC. The Said Note is not accessible to
Plaintiff and is believed to have been lost. In further answer thereto, a copy is believed to be in the
possession ofDefend~ts
Plaintiff also avers that the within Mortgage Foreclosure complaint is based upon the Mortgage and that
the attachment of a copy of the Note is unnecessary pursuant to Rules 1019(h) and 1141(a) of the
Pennsylvania Rules of Civil Procedure.
4. Contemporaneously with and at the time of the execution of the aforesaid Mortgage Note, in order to
secure payment of the same, Defendants made, executed, and delivered to original Mortgagee, a certain
real estate Mortgage which is recorded in the Recorder of Deeds Office ofthe within County and
Commonwealth conveying to original Mortgagee the subject premises. The Said Mortgage is
incorporated herein by reference.
5. The land subject to the Mortgage is: 9 WILTSHIRE WEST STREET, CARLISLE, PENNSYLVANIA
17013.

6. The said Defendants are the real owners of the property.
7. The Mortgage is in default due to the fact that Mortgagors have failed to pay the installment due on
January 0 I, 2001 and all subsequent installments thereon, and the following amouuts are due on the
Mortgage: .

The attorney's fees set forth above are in conformity with the Mortgage documents and
Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriffs Sale. Ifthe
Mortgage is reinstated prior to the sale, reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
8. No judgement has been entered upon said Mortgage in any jurisdiction.
9. Notice of intention to foreclose and accelerate the loan balance pursuant to Pennsylvania Act No.6 of
1974 is not required in that the original principal balance exceeds $50,000.00.
10. Defendants are not members of the Armed Forces ofthe United States of America, nor engaged in any
way which would bring them within the Soldiers and Sailors Relief Act of 1940, as amended.

11. The within Mortgage is insured by the Federal Housing Administration under Title II ofthe National
Housing Act and, as such, is not subject to the provisions of Pennsylvania Act No. 91 of 1983.
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure "IN REM" for the aforementioned
total amount due together with interest at the rate of 8.625% ($23.15 per diem), together with other charges and
costs including escrow advances incidental thereto to the da Sheriff s Sale and for foreclosure and sale of
the property within described.

THE FOLLOWING NOTICE IS BEING PROVIDED PURSUANT TO THE FAIR DEBT
COLLECTION PRACTICES ACT, 15 U.S.C. 1601
The uudersigned attorney is attempting to collect a debt owed to the Plaintiff, and any
information obtained will be used for that purpose. The amouut ofthe debt is stated in this
Complaint. Plaintiff is the creditor to whom the debt is owed. Unless the Debtor, within thirty
(30) days after your receipt of this notice disputes the validity ofthe aforesaid debt or any
portion thereof owing to the Plaintiff, the uudersigned attorney will assume that said debt is
valid. If the Debtor notifies the uudersigned attorney in writing with the said thirty (30) day

COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff, HOMESIDE LENDING, INC., is a Corporation, with an address of 8120 NATIONS WAY,
BUILDING 100, JACKSONVILLE, FLORIDA 32256.
2. Defendant, PAUL D. DANKOWSKY, is an adult individual, whose last known address is 9
WILTSHIRE WEST STREET, CARLISLE, PENNSYLVANIA 17013. Defendant, MELINDA S.
DANKOWSKY, is an adult individual, whose last known address is 9 WILTSHIRE WEST STREET,
CARLISLE, PENNSYLVANIA 17013.
3. On or about, Decem.ber 13, 1996, the said Defendants executed and delivered a Mortgage Note in the
sum of$102,100.00 payable to HOMESIDE LENDING, INC. The Said Note is not accessible to
Plaintiff and is believed to have been lost. In further answer thereto, a copy is believed to be in the
possession of Defendanj:s
Plaintiff also avers that the within Mortgage Foreclosure complaint is based upon the Mortgage and that
the attachment ofa copy of the Note is uuuecessary pursuant to Rules 1019(h) and 1141(a) of the
Pennsylvania Rules of Civil Procedure.
4. Contemporaneously with and at the time of the execution of the aforesaid Mortgage Note, in order to
secure payment of the same, Defendants made, executed, and delivered to original Mortgagee, a certain
real estate Mortgage which is recorded in the Recorder of Deeds Office of the within Couuty and
Commonwealth conveying to original Mortgagee the subject premises. The Said Mortgage is
incorporated herein by reference.
5. The land subject to the Mortgage is: 9 WILTSHIRE WEST STREET, CARLISLE, PENNSYLVANIA
17013.

6. The said Defendants are the real owners of the property.
7. The Mortgage is in default due to the fact that Mortgagors have failed to pay the installmeut due on
January 01, 2001 and all subsequent installments thereon, and the following amouuts are due on the
Mortgage:

The attorney's fees set f011h above are in conformity with the Mortgage documents and
Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriffs Sale. Ifthe
Mortgage is reinstated prior to the sale, reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
8. No judgement has been entered upon said Mortgage in any jurisdiction.
9. Notice of intention to foreclose and accelerate the loan balance pursuant to Pennsylvania Act No.6 of
1974 is not required in that the original principal balance exceeds $50,000.00.
10. Defendants are not members of the Armed Forces of the United States of America, nor engaged in any
way which would bring them within the Soldiers and Sailors Relief Act of 1940, as amended.

11. The within Mortgage is insured by the Federal Housing Administration under Title IIofthe National
Housing Act and, as such, is not subject to the provisions of Pennsylvania Act No. 91 of 1983.
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure "IN REM" for the aforementioned
total amount due together with interest at the rate of 8.625% ($23.15 per diem), together with other charges and
costs including escrow advances incidental thereto to the da Sheriff s Sale and for foreclosure and sale of
the property within described.

1. The complaint in the captioned action purports to be a complaint in mortgage foreclosure.
2. The Plaintiffhas attached neither a copy of the alleged mortgage nor a copy of the note that
uuderlies it, to its complaint.
3. Contrary to the Plaintifl's assertion, Defendant Paul D. Dankowsky has neither a copy of
the mortgage nor a copy ofthe note in his possession.
4. In paragraph seven of its complaint, Plaintiff purports to calculate the amouut that is due, but
does not disclose how it is calculates the per diem interest rate, the purported late charges that are
due or the alleged uupaid prinicipal balance.
5. Without the information desco"bed in the previous paragraphs hereof, Defendant Paul D.
Dankowsky is unable to adequately defend himself in the captioned action; Defendant Paul D.
Dankowskytherefore believes and avers that the Court needs to order Plaintiff to amend its complaint
in a manner that would provide the information that is missing.
WHEREFORE, Defendant Paul D. Dankowsky requests this Honorable Court to enter an
Order requiring Plaintiff to amend its complaint to provide the information that is missing as detailed

1. Plaintiff, HOMESIDE LENDING, INC., is a Corporation, with an address of 8120 NATIONS WAY,
BUILDING 100, JACKSONVILLE, FLORIDA 32256.
2. Defendant, PAUL D. DANKOWSKY, is an adult individual, whose last known address is 9
WILTSHIRE WEST STREET, CARLISLE, PENNSYLVANIA 17013. Defendant, MELINDA SUE
DANKOWSKY a/k/a MELINDA SUE ANDERSON, is an adult individual, whose last known address
is 9 WILTSHIRE WEST STREET, CARLISLE, PENNSYLVANIA 17013.
On or about, December 13, 1996, the said Defendants executed and delivered a Mortgage Note in the
sum of$102,100.00 payable to FIRST TOWN MORTGAGE CORPORATION, a copy of said Note
attached hereto md made a part hereof as Exhibit "A".
3. Contemporaneously with and at the time of the execution of the aforesaid Mortgage Note, in order to
secure payment of the same, Defendants made, executed, and delivered to original Mortgagee, a certain
real estate Mortgage which is recorded in the Recorder of Deeds Office ofthe within Couuty and
Commonwealth conveying to original Mortgagee the subject premises. A copy of said Mortgage is
attached hereto md made a part hereof as Exhibit "B". Said Mortgage was subsequently assigned to
Homeside Lending, Inc. as recorded in the aforementioned Couuty on May 29, 1997, recorded in Misc.
Book 548, Page 780. Said Assignment of Mortgage is incorporated herein by reference.
4. The land subject to the Mortgage is: 9 WILTSHIRE WEST STREET, CARLISLE, PENNSYLVANIA
17013, and is more particularly described in Exhibit"C" attached hereto and made a part hereto.

5. The said Defendants are the real owners of the property.
6. The Mortgage is in default due to the fact that Mortgagors have failed to pay the installment due on
January 01, 2001 and all subsequent installments thereon, and the following amouuts are due on the
Mortgage:

Mortgage is reinstated prior to the sale, reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
8. No judgement has been entered upon said Mortgage in any jurisdiction.
9. Notice of intention to foreclose and accelerate the loan balance pursuant to Pennsylvania Act No.6 of
1974 is not required in that the original principal balance exceeds $50,000.00.
10. Defendants are not members of the Armed Forces of the United States of America, nor engaged in any
way which would bring them within the Soldiers and Sailors Relief Act of 1940, as amended.

11. The within Mortgage is insured by the Federal Housing Administration uuder Title II of the National
Housing Act and, as such, is not subject to the provisions of Pennsylvania Act No. 91 of 1983.

total amouut due together with interest at the rate of 8.625% ($23.15 per diem), together with other charges and
costs including escrow advances incidental thereto to the date of Sheriff s Sale and for foreclosure and sale of
the property within described.

COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff, HOMESIDE LENDING, INC., is a Corporation, with an address of8120 NATIONS WAY,
BUILDING 100, JACKSONVILLE, FLORIDA 32256.
2. Defendant, PAUL D. DANKOWSKY, is an adult individual, whose last known address is 9
WILTSHIRE WEST STREET, CARLISLE, PENNSYLVANIA 17013. Defendant, MELINDA S.
DANKOWSKY, is an adult individual, whose last known address is 9 WILTSHIRE WEST STREET,
CARLISLE, PENNSYLVANIA 17013.
3. On or about, December 13, 1996, the said Defendants executed and delivered a Mortgage Note in the
sum of$102,100.00 payable to HOMESIDE LENDING, INC. The Said Note is not accessible to
Plaintiff and is believed to have been lost. In further answer thereto, a copy is believed to be in the
possession of Defendants
Plaintiff also avers that the within Mortgage Foreclosure complaint is based upon the Mortgage and that
the attachment of a copy of the Note is unnecessary pursuant to Rules 1019(h) and 1141(a) of the
Pennsylvania Rules of Civil Procedure.
4. Contemporaneously with and at the time of the execution ofthe aforesaid Mortgage Note, in order to
secure payment of the same, Defendants made, executed, and delivered to original Mortgagee, a certain
real estate Mortgage which is recorded in the Recorder of Deeds Office ofthe within Couuty and
Commonwealth conveying to original Mortgagee the subject premises. The Said Mortgage is
incorporated herein by reference.
5. The land subject to the Mortgage is: 9 WILTSHIRE WEST STREET, CARLISLE, PENNSYLVANIA
17013.

6. The said Defendants are the real owners of the property.
7. The Mortgage is in default due to the fact that Mortgagors have failed to pay the instalhnent due on
January 01, 2001 and all subsequent instalhnents thereon, and the following amouuts are due on the
Mortgage:

Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriffs Sale. Ifthe
Mortgage is reinstated prior to the sale, reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
8. No judgement has been entered upon said Mortgage in any jurisdiction.
9. Notice of intention to foreclose and accelerate the loan balance pursuant to Pennsylvania Act No.6 of
1974 is not required in that the original principal balance exceeds $50,000.00.
10. Defendants are not members ofthe Armed Forces of the United States of America, nor engaged in any
way which would bring them within the Soldiers and Sailors Relief Act of 1940, as amended.

11. The within Mortgage is insured by the Federal Housing Administration under Title II of the National
Housing Act and, as such, is not subject to the provisions of Pennsylvania Act No. 91 of 1983.
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure "IN REM" for the aforementioned
total amouut due together with interest at the rate of 8.625% ($23.15 per diem), together with other charges and
costs including escrow advances incidental thereto to the da Sheriff s Sale and for foreclosure and sale of
the property within described.
