TO: THE HONORABLE JUDGES OF SAID COURT:
Petitioner, Nicholas Ryan Leuschen, by his attorney, Kenneth
F. Lewis, peti tions the Court to appeal the suspension of his
driver's license and in support thereof offers the following:
1. Petitioner Nicholas Ryan Leuschen resides at
919 Acri Road, Mechanicsburg, PA 17055.
2. By letter dated May 21,2001, PennDOT notified
Petitioner his license was to be suspended for
violating 75 Pa.C.S. S3362 (exceeding maximum
speed). A copy of the notice attached hereto.
3. Peti tioner' s suspension is scheduled by
PennDOT to begin June 25, 2001.
4. Peti tioner is permi tted to appeal the
suspension of his license to the Court of
Common Pleas.
WHEREFORE, Petitioner respectfully requests the Court to
schedule a hearing on the subject suspension and to issue a stay of
the suspension pending such hearing.

No. 01-3225 (Driver's License Suspension Appeal)
Dear Judge Guido:
Pursuant to my telephone conversation with Sandy
yesterday, enclosed you will find an Order for your review and
signature continuing the above appeal which is scheduled for
Friday, July 27, 2001 at 11:00 a.m.
Mr. Leuschen's license was suspended based upon a guilty
plea which he was subsequently permitted to withdraw. If the
hearing is scheduled for October, the underlying speeding offense
will, in all likelihood, have already been decided (and the appeal
should not be necessary (regardless of the result of the underlying
offense).
I have spoken with George Kabusk, Esquire, with the
Office of Chief Counsel at PennDOT, who concurs in this request.
I was advised that a formal Motion for continuance would not be
necessary. Of course, if you would like any further information or
documentation (or a formal filing), please let me know.
