WAIVER OF LIENS
WHEREAS, Kevin C. Bear and Jodie 1. Bear, of Cumberland County, Pennsylvania, entered into a contract
with S & A Custom Built Homes, Inc., of Cumberland County, Pennsylvania, to provide materials and perform
labor necessary for completion of a residential dwelling situate upon lot of ground located:
Lot A North Middle Road, Newville, PA 17241, Upper Mifflin Township Township, Cumberland County,
PENNSYLVANIA, as more particularly set forth in Exhibit "A" attached hereto.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said
contract and for the consideration t-herein set forth, that neit.~er thc undersigned contractor, any sub-contractor or
material man, nor any other person furnishing labor or materials to the said contractor under this contract shall
file a lien for work done or materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in
accordance with the requirements of the Act of Assembly of Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto have hereunto set their hands and seals this 11th day of May,
2001.

EXHIBIT "A"
ALL lHAT CERTAIN tract of land being situated in UPPER MIFFLIN TOWNSHIP, Cumberland County, Pennsylvania, bounded
and described in accordance with a subdivision Plan for Samuet L. and Katie S. Fisher, by Stephen G. Fisher, Professional Land
Surveyor, dated August 4, 1989, revised August 30, 1989, and recorded in Cumberland County Plan Book 59, Page 8, as follows:
BEGINNING at an iron pin set at the northwest corner of Lot 8 on the hereinafter mentioned plan oflots; thence by the eastern line of
a fIfty (50) foot wide private right-of-way, North ten (10) degrees twenty-six (26) minutes fifty (50) seconds East, fIfty-one and
twenty one-hundredths (51.20) feet to an existing iron pin being corner oflands now or formerly of Raymond Lynn Fisher and wife;
thence by said lands and addition "B" on said plan of lots, North two (02) degrees zero (00) minutes zero (00) seconds West, three
hundred eighty-two and sixty-three one-hundredths (382.63) feet to an iron pin set on line of lands now or formerly of Samuel D.
Shenk; thence by said lands of Samuel D. Shenk, North eighty-fIve (85) degrees fIve (05) minutes zero (00) seconds East, four
hundred sixty-one and thirty-seven one-hundredths (461.37) feet to an existing fence post; thence by the same, South two (02)
degrees zero (00) minutes (00) seconds East four hundred fifty-six and eleven one-hundredths (456.11) feet to an iron pin set being
the northeast corner of Lot 8 on said ptan of lots; thence by said Lot 8, South eighty-eight (88) degrees zero (00) minutes zero (00)
seconds West, four hundred seventy-one and eighty-one one-hundredths (471.81) feet to an iron pin set, the place of BEGINNING.
Containing 4.71 acres.
BEING the same premises which Kevin C. Bear, Married man, by Deed dated the 5th day of February, 1999, and recorded at
Cumberland County in the Office of the Recorder of Deeds, in and for the County of Cumberland, on the 10th day of February, 1999,
in Record Book 194, Page 49, granted and conveyed unto Kevin C. Bear and Jodie L. Bear, Husband and wife.
UNDER AND SUBJECT TO restrictions and conditions as now appear of record.
