STIPULATION AGAINST LIENS
WHEREAS, Wheatland Custom Homes, Inc. , of 447 Granite Run Drive,
Lancaster, Pennsylvania, is about to execute contemporaneously herewith, a contract with
Wheatland Custom Homes, Inc. of 447 Granite Run Drive, Lancaster, Pennsylvania, for the
erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN parcel of land situate in Hampden Township,
Cumberland County, Commonwealth of Pennsylvania, being more particularly bounded and
described as follows, to wit:
BEGINNING at a point at the intersection of Sommerton Drive and JerusaleTM
Road at the northeastern comer of Lot No. 134 as shown on the hereinafter mentioned plan of
lots: thence along Sommerton Drive South 39 degrees 12 minutes 40 seconds West, a distance
of 16.66 feet to a point; thence continuing along the western right-of-way of Sommerton Drive
by a curve having a radius of 75.00 feet and an arc length of 22.13 feet to a point; thence
continuing South 56 degrees 07 minutes 05 seconds West, a distance of 76.14 feet to a point at
the dividing line between Lot No. 134 and Lot No. 135; thence along said dividing line North 33
degrees 52 minutes 55 seconds West, a distance of 91.26 feet to a point; thence North 56 degrees
25 minutes 10 seconds East, a distance of 100.20 feet to a point on the southern right-of-way line
of Jerusalem Road; thence along said right-of-way line of Jerusalem Road South 50 degrees 03
minutes 14 seconds East, a distance of73.19 feet to a point; thence continuing by a curve having
a radius of 10.00 feet and an arc length of 15.58 feet to a point, said point being the Place of
BEGINNING.
CONTAINING 10,069.42 square feet and BEING Lot No. 134 on Final
Subdivision Plan of Hampden Hearth Phase IV Subdivision Plan, prepared by Grove Associates
and recorded for the County of Cumberland in Plan Book 68, Page 66.
UNDER AND SUBJECT to an easement for the erection and maintenance of
signs, plantings, privacy berms, fencing and m asom-y appropriate for a n entry w ay t o t he
development reserved in favor of Grantor over a portion of the premises described as follows to
be maintained by Grantor or its assigns.
NOW, the '~ ~ day of May, 2003, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said
Wheatland Custom Homes, Inc., to the said Wheatland Custom Homes, Inc. to commence work
on the said building, or purchase materials for the same in consideration of the making of the said
contract with Wheatland Custom Homes, Inc. and the further consideration of One Dollar, to
Wheatland Custom Homes, Inc. paid by Wheatland Custom Homes, Inc., it is agreed that no
lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the
material men or workmen or any other person for any labor, or materials purchased, or extra labor
or materials purchased for the erection of said building, the right to file such liens being expressly
waived.
WITNESS, our hand and seals the day and year aforesaid.
