HOFFMAN, tJd/b/a HOFFMAN'S CUSTOM CONTRACTING Contractor Whereas, FREDERICK G. HUEBNER, JR., and FLORENCE M. HUEBNER, his wife, of1344 Georgetown Circle, Carlisle, Cumberland County, Pennsylvania are about to execute contemporaneously herewith, a contract with TIMOTHY D. HOFFMAN, tld/b/a HOFFMAN'S CUSTOM CONTRACTING, of 21 Annendale Drive, Carlisle, Cumberland County, Pennsylvania, for the erection of a dwelling house upon a lot of land situate in Dickinson Township, Cumberland County, Pennsylvania, being known as Lot No. 70, Clarendon Development, as recorded in Cumberland County Plan Book 77, Page 56 (Legal Description: ALL THAT CERTAIN lot ofland situate in Dickinson Township, Cumberland County, Pennsylvania, bounded and described in accordance with Subdivision Plan for Clarendon, prepared by Statler-Brehm Associates, Inc., dated June 10, 1998 consisting of14 pages, a copy of which was recorded in the hereinafter named Recorder's Office on August 19, 1998 in Plan Book 77, Page 56, which Subdivision Plan for Clarendon is incorporated herein by reference, as follows: BEGINNING at a point on the northern line of 50 feet wide Ashton Street at the dividing line between Lots Nos. 70 and 71; thence along the northern line of said 50 feet wide Ashton Street by a curve to the right having a radius onoo feet an arc distance of 443.94 feet to a point at the dividing line between Lots Nos. 69 and 70; thence along said dividing line between Lots Nos. 69 and 70, north 60 degrees 15 minutes 15 seconds east a distance of299.22 feet to a point at comer common to Lots Nos. 69 and 70; thence along said dividing line between said Lots Nos. 69 and 70 and continuing along the dividing line between Lots Nos. 70 and 71, south 32 degrees 56 minutes 08 seconds east a distance of256.09 feet to a point on the northern line of Ashton Street at the Place of BE GINNING) . Now, June 4, 2001, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with them and the further consi<\eration of one Dollar, to Contractor paid by Owners it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
