CIVIL ACTION - LAW

Prior Judge: The Honorable Edward E. Guido
CONCILIATION CONFERENCE SUMMARY REPORT
IN ACCORDANCE WITH THE CUMBERLAND COUNTY RULE OF CIVIL
PROCEDURE 1915.3-8(b), the undersigned Custody Conciliator submits the following report:
1. The pertinent information pertaining to the child who is the subject of this litigation
is as follows:
Analeigh M. Englehart, born January 16, 1998
2. A Conciliation Conference was held on March 15, 2012, with the following
individuals in attendance:
the mother, Melissa Reese, with her counsel, Michael J. Whare,
Esquire, and the maternal grandmother, Teresa Englehart, with
her counsel, Barbara Sumple-Sullivan, Esquire.
3. This case involves a situation where the Maternal Grandmother has custody pursuant
to an Order from 2006. At that time, the Court Order gave Mother very limited
custody and specified that it would need to be supervised. However, over the past
five years or so, the Mother has had limited contact with the minor child. Mother is
currently living in California, and the minor child lives in Camp Hill with the
Maternal Grandmother.
4. Mother now petitions the Court seeking primary physical custody of the minor child
and suggests that the minor child is now telling the Mother that she wants to go to
live with the Mother. However, it was developed at the conciliation conference that
the Mother has had little contact with the child over the past few years except for
some recent communications via email, Facebook, etc. The Mother has a history of
mental illness. Apparently, there are some issues developing at this time between the
minor child and the Maternal Grandmother.
5. Recognizing the complexities of this case, the parties agreed to have a custody
evaluation completed with the Mother paying for the cost for the evaluation.
6. The child's father is not involved in the matter and his rights were terminated in
conjunction with a prior adoption proceeding. However, the adoption was not
consummated as the Mother withdrew her consent at that point.
7. The Conciliator recommends the entry of an Order in the form as attached.
