STIPULATION AGAINST LIENS
WHEREAS, KEVIN C. WESTRA and CINDY JilL WESTRA, his wife, of
3820 Carriage House Drive, Camp Hill, Cumberland County, Penm:ylvania, hereinafter called
"Owner" are about to execute contemporaneously herewith a contract with THOMAS J.
CAlUUCATO AND SONS, INC. of 50 Lester Road, Harrisburg, Dauphin County, hereinafter
called "Contractor" for the erection, construction, alteration or repair of a building and other
improvements upon the propeny and real estate known as Lot #5, Witney Ridge, Upper Allen
Township, Cumberland County, Pennsylvania, more particularly described in a Deed dated May 17,
2001 and recorded May 22,2001 in Deed Book 244 at Page 1144, Cumherland County records.
NOW THEREFORE, it is stipulated and agreed between the parties, as part of
the contract and in further consideration thereof. that neither the Contra.:tor or any subcontractor or
materialmen, nor any person furnishing labor and materials under the contract or any supplemental
contract, may file a lien, commonly called a Mechanics' Lien, rnder the contract or any
supplemental contract, oral or written, for work done or materials lilrnished, such right being
expressly waived. Contractor warrants and represenrs that no work of any kind has been done and
no materials have been furnished, delivered or ordered in cOlUlection with the contract or any
supplemental contract for extra work. Contractor further agrees to ind(:mnify Owner from any and
all damages, costs, and expenses, including reasonable attorney's fees suffered by Owner as a result
of any lien filed or claim asserted against the property by Contra.:tor, or any subcontractor,
materialmen, worlonen or any other person in violation of this stipulatio 11.
