WHEREAS, Harry B. Clark and Joyce B. Clark, Owners,are about: to
execute contemporaneously herewith, a contract with Joy-Ark Builders Inc.
for the construction of a residential dwelling on Lot 452 of the Plan of
The Highlands of Hampden, Phase III, recorded in Plan Book 59, Page 137,
more particularly described in Exhibit"A" hereto attached and known as 1102
Tiverton Road, Mechanicsburg, PA.
NOW, T,yry, /D ,2001, at the time of and immediately before
execution of the principal contract, and before any authority has been
given by the said Owners to Contractor to commence construction, or
purchase materials for the same in consideration of the making of t:he said
contract wit:h Contractor and the further consideration of One Dollar to
Contractor paid by Owners it is agreed that no lien shall be filed against
said real estate or improvements erected thereon by the cont:ractor, or any
subcontractor, nor by any of the materialmen or workmen or any other person
for any labor, or materials purchased, or extra labor or materials
purchased for the said construction, the right: to file such liens being
expressly waived.

ALL THAT CERTAIN lot or tract ofland situate in Hampden Township, Cumberland County,
Commonwealth of Pennsylvania more particularly bounded and described as follows, to wit:
BEGINNING at a point on the eastern dedicated right-of-way line of Tiverton Road at the
dividing line of Lot #451 and Lot #452;
THENCE by the eastern right-of-way line of Tiverton Road North 14 degrees 00 minutes 00
seconds West 100.00 feet to a point at the dividing line of Lot #453 and Lot #452; Thence by line
of Lot #453 North 76 degrees 00 minutes 00 seconds East 1J0.00 feet to a point; Thence by lands
of the Highlands of Hampden Square, Phase IV South 14 degrees 00 minutes 00 seconds East
