STIPULATION AGAINST LIENS
THIS AGREEMENT made this ",19 day of ~ ,2001, by and
between Terry S. Leiby & Son, of Carlisle, C mberland County,
Pensylvania, hereinafter referred to as Contractor,
AND
Clarence E. Spoerl, hereinafter referred to as Owner, whereby the
contractor undertook and agreed to erected and construct a
dwelling on the certain lot of ground situate in Penn Township,
Cumberland County, Commonwealth of Pennsylvania, and more fully
described in Exhibit "A" which is attached hereto and made_a, p<l,.rt

NOW THEREFORE, THIS AGREEMENT WI~SSETH: That the said
Contractor, for an in consideration of the sum of ($1. 00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
filB, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

ALL that certain tract of land situate in Penn Township, Cumberland County,
Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point on the eastern side of Fox Hollow Lane, on the dividing line
between Lots 18 and 19 on the hereinafter Final Subdivision Plan; thence by said
Fox Hollow Lane North 04 degrees 04 minutes 48 seconds East 359.99 feet to a
point; thence by Fox Hollow Lane by a curve to the right having a radius of 25.00
feet, an arc length of 39.27 feet to a point on Deer Ridge Lane; thence by Deer Ridge
Lane South 85 degrees 55 minutes 12 seconds East 50.00 feet to a point; thence by
the same by a curve to the right having a radius of 175.00 feet, an arc 'length of 61.34
feet to a point, thence by the same by a curve to the right having a radius of 25.00
feet, an arc length of 28.90 feet to a point; thence by the same by a curve to the left
having a radius of 60.00 feet, an arc length of 42.34 feet to a point; thence by the
dividing line between Lots 19 and 20 South 04 degrees 04 minutes 48 seconds West
314.56 feet to a point; thence by the dividing line between Lots 18 and 19 North 85
degrees 55 minutes 12 seconds West 168.25 feet to a point, the place of
BEGINNING.
CONTAINING a total area of 1.4505 acres and being Lot No. 19 on the Final
Subdivision Plan for Maple Grove (Phase 2) recorded in the Recorder of Deeds in
and for Cumberland County in Plan Book 79, Page 80.
