STIPULATION AGAINST LIENS
WHEREAS, V ARTAN NATIONAL BANK, the OWNER of the real estate described below, has or is about
to execute a General Contract with V ART AN CONSTRUCTION COMPANY, (VCC), whose principal place of business
is located at 3601 Vartan Way, Harrisburg, Pennsylvania 17110 to complete renovation work for the project located at
6480 Carlisle Pike in Mechanicsburg, Silver Spring Township, Cumberland County, Pennsylvania, as more particularly
bounded and described on Exhibit "A", attached hereto and made a part hereof; and
NOW, THEREFORE, this M!LdaY~, 200 I, before any authority had been given by V ART AN
NATIONAL BANK to VCC to commence work on 'd facilities, or purchase materials for same, in consideration of
making of the above described Contract with V ART NATIONAL BANK, OWNER, and in further consideration of
One Dollar ($1.00) paid to the Contractor by VARTAN NATIONAL BANK, the receipt whereof is hereby
acknowledged, it is agreed that no liens or claims shall be filed or maintained against the Owner's facilities and the land
above described, by the Contractor, or any of its subcontractors, or by any of the materialmen or workmen, or any other
person acting through or under them, for or on account of any labor, or materials purchased, or extra labor or materials
purchased for, towards, in or about the erection, construction, design and improvement of said facilities, under said
contract or otherwise, the right to have, file and maintain such liens or claims against the facilities, the land above
described, being hereby expressly waived by the Contractor for itself, its subcontractors, all materialmen, or workmen
and others acting through or under them.

LEGAL DESCRIPTION
6480 CARLISLE PIKE
MECHANICSBURG, PENNSYLVA.NI.A.
ALL THAT CERTAIN piece or parcel of land situate in the Township of Silver Spring,
County of Cumberland and State of Pennsylvania, more particularly bounded and
described in accordance with a survey made by William B. Whittock, Professional
Engineer dated July 19, 1971, as follows, to wit:
BEGINNING at a point, said point being the intersection of the northern right of way line
of the Carlisle Pike (L.R. #34) and the western right of way line of Samples Bridge Road
(T-596): thence along the northern right of way line of the Carlisle Pike the following 4
courses and distances: (1) South 40 degrees 43 minutes 04 seconds West, a distance
of 16 feet to a point: (2) North 86 degrees 23 minutes 50 seconds West, a distance of
40 feet to a point, (3) South 03 degrees 36 minutes 10 seconds West, a distance of 10
feet to a point, (4) North 86 degrees 23 minutes 50 seconds West, a distance of 172.73
feet to a point; thence along land now or late of Mervin Raudabaugh North 02 degrees
45 minutes East, a distance of 142.45 feet to a point; thence along the same North 84
degrees 45 minutes East, a distance of 12.50 feet to a point; thence along the same
North 5 degrees 15 minutes West, a distance of 22.1 feet to a point; thence along land
now or late of Mrs. Lewis Baker, North 89 degrees 34 minutes 43 seconds East, a
distance of 182.63 feet to a point; thence along the western right of way line of the
Samples Bridge Road (T-596), South 8 degrees 48 minutes 20 seconds East, a
distance of 160.06 feet to a point the place of BEGINNING.
CONTAINING 35,464.19 square feet or 0.814 acres.
TOGETHER with and subject to a 20 feet wide right of way easement for the free and
uninterrupted use, liberty and privilege of, and passage by the Grantee herein, their
successors and assigns, in common with the adjacent owners, their heirs and assigns,
as a private drive or road located in, over, along and through the western 10 feet of the
land hereinabove described and in over, along and through the eastern 10 feet of lands
of Marvin Raudabaugh immediately adjacent to the land hereinabove describee!, and
extending from the center line of public highway U.S. Route No. 11 (Carlisle Pike) in a
northerly direction a distance of 190 feet, as said private drive or road as shown on the
survey attached to Deed recorded in Deed Book P, Volume 21, Page 880.
BEING THE SAME PREMISES WHICH PNC Bank, National Association by Deed dated
Septernber 27, 1999, and recorded September 29, 1999, in the Recorder of Deeds
Office in and for Cumberland County, Pennsylvania in Deed Book 208, Page 667,
granted and conveyed unto Donald L. Carter.
