You have been sued in court. If you wish to defend against the claims set forth in the following
pages, you must take action within twenty (20) days after this complaint and notice are served, by
entering a written appearancEl personally or by an attorney and filing in writing with the court your
defenses or objections to the claims set forth against you. You are warned that if you fail to do so the

COMPLAINT
1. Plaintiff is a corporation with offices at Triad Center, 4161 Piedmont, Greensboro,
North Carolina, 27409-6012.
2. Defendant, Otis R. Nash, is an adult individual residing at 26 Iron Gate Circle,
Mechanicsburg,PA 17055.
3. Defendant, Monica L. Nash, is an adult individual residing at 1850 Graves Road,
Apt 216, Norcross, GA 30093
4. On or about June 19, 1998, Defendants duly executed a Simple Interest Contract
(hereinafter the "Contract") in favor of Plaintiff, a true and correct copy of said Contract and
Security Agreement is attached hereto, marked as Exhibit "1" and made a part hereof.
5. Pursuant to said Contract, Defendants took possession of the vehicle more
particularly identified as a 1995 Suzuki Esteem, Serial Number JS26B3186S5100609.
6. Defendants defaulted under the terms of the parties' agreement by failing to make
payment to Plaintiff as promised, thereby rendering the entire balance of the Contract
immediately due and payable.

7. By the terms of the parties' agreement, more specifically the "acceleration clause"
therein, Defendants' default made the entire balance of the loan immediately due and payable.
8. Due to Defendant's default under the Contract, the vehicle was repossessed by
Plaintiff on or about August 13, 2000.
9. Thereafter, a commercially reasonable sale was conducted and the vehicle was
resold on or about September 26,2000 for $1 ,350.00.
10. After applying the net sale proceeds to the balance due under the Contract,
Plaintiff avers that a deficiency balance of $5,479.27 is due from Defendants.
11. Plaintiff avers that the written agreement between the parties provides that
Plaintiff is entitled to interest at the rate of $1.72 per diem.
12. Plaintiff avers that interest from April 17,2001 to May 8,2001 calculated at the
aforesaid rate amounts to $36.12.
13. Plaintiff avers that the Contract between the parties provides that Defendants will
pay Plaintiffs reasonable attorneys' fees in the event of collection.
14. Plaintiff avers that such attorneys' fees amount to $1,824.60.

15. Although repeatedly requested to do so by Plaintiff, Defendants have willfully
failed and/or refused to pay the principal balance, attorneys' fees, interest or any part thereof to
Plaintiff.
WHEREFORE, Plaintiff demands Judgment in its favor and against Defendants, Otis R.
Nash and Monica L. Nash and , jointly and severally, in the amount of $7,339.99 with
appropriate additional attorneys' fees and continuing interest thereon at the rate of $1.72 per
diem from May 8, 2001 plus costs.
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED SHALL
BE USED FOR THAT PURPOSE.
