Your Petitioner, Dustin Cassell, is an individual residing at 116 Cedar Lane, Carlisle, Cumberland County, Pennsylvania, 17013, 2. On or about May 16, 2001, Petitioner allegedly received a Notice from the Pennsylvania Department of Transportation notifYing him that his present operator's license, bearing card number 26462605, was being suspended for a period of ninety days effective June 20,2001. A true and correct copy of said notice is attached hereto, made a part hereof and marked as Exhibit "A." 3, 'Said suspension arises out of the Petitioner's alleged violation of Section 3362 of the Vehicle Code on February 11, 2001 after which he had an accumulation of six points or more. 4, On May 8, 2001, Petitioner was found guilty of the violation of Section 3362 of the Vehicle Code, 5. On June 7, 2001, Petitioner filed an appeal from summary conviction on the grounds that Petitioner's speedometer was tested and it was determined that it was showing an incorrect reading of 5 miles per hour less than the speed that he was actually driving. If appeal is granted and the violation is dropped or lessened, Petitioner will not have sufficient amount of points to constitute suspension of operator's license. 7.
