STIPULATION AGAINST LIENS
WHEREAS, THE GARTH ULLOM FAMILY LIMITED PARTNERSHIP ("Owner"), the
Owner of the real estate described below, have executed a Contract dated :::fu JJe. J 9. 200 J
with R.S. MOWERY & SONS, INC. ("Contractor"), whose principal place of business is located
at 625 Hamilton Street, Carlisle, Pennsylvania 17013 and more particularly bounded and
described on Exhibit "A", attached hereto and made a part hereof; and
NOW, THEREFORE, this 19# day of ,j'l,uJe... ,2001, before any
authority had been given by Owner to Contractor to commence work on said facilities or
purchase materials for same, in consideration of making of the above-described Contract with
Owner, and in further consideration of One ($1.00) Dollar paid to Contractor by Owner, the
receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed or
maintained against the Owner's facilities and the land above-described by the Contractor or any
of its subcontractors, or by any of the materialmen or workmen, or any other person acting
through or under them, for or on account of any labor or materials purchased, or extra labor or
materials purchased for, towards, in or abut the erection, construction, design and improvement
of said facilities, under said contract or otherwise, the right to have, file and maintain such liens
or claims against the facilities and the land above-described, being hereby expressly waived by
the Contractor for itself, its subcontractors, all materialmen, or workmen and other acting
through or under them.

EXHIBIT "A"
ALL THAT CERTAIN parcel or lot of land situate in Silver Spring Township,
Cumberland County, Pennsylvania known as Lot #2B on a Final Limited Resubdivision
for Wood's Drive Associates prepared by H. Edward Black and Associates dated
February 27, 1992. revised March 23, 1992 and recorded in the Cumberland County
Recorder of Deeds Office in Plan Book 65, Page 12; as more particularly bounded and
described as follows, to wit:
BEGINNING at a concrete monument on Commerce Drive at a common comer with Lot
2A; thence along the common boundary with Lot 2A the following four (4) courses and
distances; South 49 degrees 38 minutes '56 seconds East 120.00 feet to an iron pin;
thence North 40 degrees 21 minutes 04 seconds West a distance of 196.52 feet to a
concrete monument; thence South 67 degrees 22 minutes 13 seconds West 482.96
feet to an iron pin; thence North 22 degrees 37 minutes 47 seconds West a distance of
300.00 feet to a concrete monument; thence along the legal right-of-way line of U.S.
Route 11 (SR 0011) North 67 degrees 30 minutes 43 seconds East a distance of
607.67 feet to a point; thence South 22 degrees 51 minutes 30 seconds East a
distance of 139.76 feet to a point; thence on a curve to the left having a radius of 1030
feet, an arc distance of 314.47 feet, the tangent bearing of which is South 17 degrees
29 minutes 34 seconds East, to a concrete monument, the place of BEGINNING.
CONTAINING 4.696 acres more or less.
Being Part of Parcel No. 38-19-1614-008.
BEING the same premises which Wood's Drive Associates, a Pennsylvania general
partnership, by its Deed dated December 22,2000 and recorded December 27,2000 in
the Cumberland County Office of the Recorder of Deeds in Deed Book 236, Page 882,
granted and conveyed unto The Garth Ullom Family Limited Partnership, a Delaware
limited partnership.
