WHEREAS, Marc E. Sable and Diane E. Sable of 910 Robertt Street, Mechanicsburg,
Pennsylvania 17055, is about to execute contemporaneously herewith, a contract, with HARRY L.
SMITH & SONS, INC., of 5943 Devonshire Heights Road, Harrisburg, Pennsylvania ]7112, for the
erection of a bnilding upon premises commonly known as Rich Valley Manor Lot #6, Cumberland County,
Pennsylvania, as set forth in the deed dated '-...1- -1- Y'f , W--_, at DeedlRecord Book
I ct S- , Page .57. f , in the Recorder's Office for Cnmhprl ~nn County, Pennsylvania, as
more specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, illne 11 , 20Q1,:,;at the time of and immediately before the execution of
the principal contract, and before any autliority has been given by the said Owner to the said Contractor to
commence work on the said building, or purchase materials for the same in consideration of the making of
the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid
by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any
subcontractor, nor by any of the n;IlIteriahnen or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased fo~ the erection of said building, the right to file such liens
being expressly waived.

BEGINNING at a point, said point being located on the Northern right-of-way line of

Carolhers Circle wilh Ihe Northern right-of-way line of Willow Mill Park Road; thence along
the Northern right-of-way line of Willow Mill Park Road in a Westerly direction on the arc of
a curve, curving to the right, having a radius of 875.00 feet and an arc length of 83.89 feet to a
poinl; thence along the same, South 45 degrees 10 minutes 30 seconds West, a distance of303.63
feet to a point at Lot #5, of Rich Valley Manor, Phase II; thence along Lot #5, North 44 degrees
49 minutes 30 seconds West, a distance of 325.00 feet to a point at Lot #7 of Rich Valley Manor,
Phase II; thence along Lol #7, North 45 degrees 10 minutes 30 seconds Easl, a distance of 410.00

BEING a part of the premises which Joseph T. Simpson and Helen M. Simpson, his wife,
by Iheir deed daled and recorded January 16, 1978, in the Office of the Recorder of Deeds in and
for Cumberland County, Pennsylvania, in Deed Book P, Volume 27, Page 647, granted and
conveyed to Jerry T. Simpson and Hilary M. Simpson, his wife, Granlors herein.
UNDER AND SUBJECT nevertheless, to the specific certain conditions and restrictions
as set forth in the Declaralion of Restrictive Covenallls as appears of record in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania, in Miscellaneous Book 413,
Page 11.
UNDER AND SUBJECT nevertheless, to all olher conditions and restrictions of record,
if any, as they may appear.
The aforesaid Rich Valley Associates has joined in as Grantor in Ihis conveyance to
Iransfer any right, title or interest it may have in said property pursuant 10 any unrecorded
Agreement of Sale belween Rich Valley Associales and Jerry T. Simpson and Hilary M. Simpson,
his wife, Grantors herein.
