Dear Attorney Bailey:
I am responding to our telephone conversation of September 7, 2001 in which we
discussed the above-mentioned matter.
As you are aware, the Department by notice dated May 2, 2001 notified your client that
his driving privilege would be suspended indefinitely, effective May 23, 1001, pursuant to
Section 1533 of the Vehicle Code as a result of his failure to respond to a citation number
J067l7ll5. That notice informed the licensee that he could avoid the suspension ifhe responded
to the citation before May 23, 2001.
Additionally, the Department by notice dated June 20,2001 notified your client that his
driving privilege would be suspended for 20 days, effective June 20, 2001, pursuant to Section
1544 of the Vehicle Code as a result of his conviction on June 12,2001 of violating Section 3362
of the Vehicle Code on March 8, 2001. The citation associated with this violation was citation
number J067l7ll5. The report of conviction indicated that the response date was the conviction
date.
The documents that you submitted in the appeal indicated that the petitioner responded to
the citation in a timely manner by paying the amount as indicated on the Warrant of Arrest to an
Officer Malloy on May 15, 2001 but that there was a delay in the transmission of that response to
the issuing authority. The documents indicate that the District Justice received the response on
June 12, 2001.
As I informed you on the telephone, the Department will correct its records to indicate
that your client responded to the citation on May 15, 2001. That response date would be a timely

response to the citation. As a result, the Department will rescind and delete the Section 1533
indefinite suspension. Additionally, the Department will rescind and delete the Section 1544 20
day add-on suspension. However, as you are aware, and as you agreed, the 3362 conviction will
result in the imposition of four points on your clients driving record.
I have attached computer prints outs confirming that the Department corrected its records.
You will note that the 1533 and the 20 add-on were rescinded and deleted and that the 3362
resulted in 4 points.
A hearing is scheduled for September 24,2001, at 3:30 p.m. in Courtroom No.2,
Cumberland County, Carlisle. As a result of the motorist's record being corrected, a hearing is
not necessary. The matter could be disposed of by you withdrawing the appeal or by having a
hearing and having the matter dismissed as moot. If you choose to file a praecipe to withdraw,
kindly provide me with a copy ofthe praecipe so that I may close-out my file.

MOTION TO VACATE AND RECONSIDER
COMES NOW the Petitioner Michael L. Paoletta by and through Don
Bailey his attorney and requests that this Court vacate and reconsider its June 25,
2001 Order denying him an appeal from the suspension of his motor vehicle
operator privileges and in support thereof avers as follows:
1.) Petitioner earli~r represented himself before this Court.

2.) Petitioner did not present this Court with a copy of Exhibit "A" hereto
which is the Certified Driving History of the Petitioner Michael L. Paoletta.
3.) Previously before the Court was a copy (Exhibit "B" hereto) ofa June 13,
2001 notification to Petitioner, from PennDot, telling him his license was suspended.
4.) A comparison of Exhibit "A" and Exhibit "B" clearly demonstrates that
Petitioner did not have his driver's privileges suspended because of speeding (ie. he
did not have any points on his driving record when the subject citation (84- MPH in
a 65 -MPH zone) was written on March 8, 2001 and thus that citation could not
have been the basis for a suspension.
5.) Petitioner had a warrant issued for him for failure to respond to the March
8,2001 citation. See Exhibit "c" hereto, but he subsequently pled guilty and paid
his costs and fines to an "Officer Malloy" on May 15, 2001. See Exhibit "D" hereto
which is an explanatory letter from D.J. Brenda M. Knepper, well before his May
23,2001 deadline.
6.) Consequently, when Petitioner received his letter of suspension he
realized it was an error, and he filed a "Notice of Appeal," Exhibit "E" hereto and
sought a hearing before this Court.
7 .) When this Court ruled (see Exhibit "F" hereto) the Court denied
Petitioner a Hearing, and in footnote 1 to the Order, indicated that PennDot had

suspended Petitioner's license for speeding.
8.) An examination of Petitioners driving record indicates that PennDot made
an error (as PennDot staff worker Mrs. Mosey indicated) and that this Court erred
because Petitioner, proceeding pro-se, had failed to produce a copy of his Certified
Driving Record.
WHEREFORE this Court is respectfully requested to vacate and reconsider
its June 25, 2001 Order and grant Petitioner's request for a hearing or, in the
alternative, to reverse the Petitioner's suspension of privileges.

Section 1544 of the Vehicle Code requires PennDOT to extend
any eXisting suspension 5 days for each point that would

NOTICE OF APPEAL
1. Appellant, Michael L. paoletta is an adult
currently resides at 1771 South Meadow Drive,
Pennsylvania, Cumberland County, Pennsylvania.
2.Appellee, Commonwealth of Pennsylvania, Pennsylvania Department
of Transportation, Bureau of Driver Licensing, Harrisburg, Dauphin
County, Pennsylvania, 17123 is a state agency.
3. Your Appellant was arrested for speeding on or about March 8,
2001, near Fort Littletown, Pennsylvania.
4. Your Appellant was notified on or about June 16th, 2001, that
his license was being suspended for a period of twenty days for not
paying the fine before May 23, 2001. A true and correct copy of the
Notice is attached as Exhibit "An.
5. Your A.ppellant did pay the cost of the ticket on May 15,2001 to
Officer Malloy of the Pennsylvania State Police. A true and correct
copy of proof is attached as Exhibit "B".
6. Your Appellant was told by Officer Malloy that he would notify
District Justice Knepper before the 23th of May. Officer Malloy
claims to have preform his duties as required but Judge Knepper did
not receive the check from Officer Malloy until June 12, 2001.
Officer Malloy was acting as a agent for the district court and
that suspension should not be granted. A true and correct copy of
proof is attached as Exhibit"C".
7. Your Appellant has a letter written by Judge Knepper showing the
actual date of payment was 5~15-01. A true and correct copy of
proof is attached as Exhibit "D".

NOTICE OF APPEAL
1. Appellant, Michael L. Paoletta is an adul t individual whom
currently resides at 1771 South Meadow Drive, Mechanicsburg,
Pennsylvania, Cumberland County, Pennsylvania.
2.Appellee, Commonwealth of Pennsylvania, Pennsylvania Department
of Transportation, Bureau of Driver Licensing, Harrisburg, Dauphin
County. Pennsylvania, 17123 is a state agency.
3. Your Appellant was arrested for speeding on or about March 8,
2001, near Fort Littletown, Pennsylvania.
4. Your Appellant was notified on or about June 16th, 2001, that
his license was being suspended for a period of twenty days for not
paying the fine before May 23, 2001. A true and correct copy of the
Notice is attached as Exhibit "A".
5. Your Appellant did pay the cost of the ticket on May 15,2001 to
Officer Malloy of the Pennsylvania State Police. A true and correct
copy of proof is attached as Exhibit "B".
6. Your Appellant was told by Officer Malloy that he would notify
District Justice Knepper before the 23th of May. Officer Malloy
claims to have preform his duties as required but Judge Knepper did
not receive the check from Officer Malloy until June 12, 2001.
Officer Malloy was acting as a agent for the district court and
that suspension should not be granted. A true and correct copy of
proof is attached as Exhibit"C".
7. Your Appellant has a letter written by Judge Knepper showing the
actual date of payment was 5-15-01. A true and correct copy of
proof is attached as Exhibit "D".

WHEREFORE, your Appellant respectfully requests your Honorable Court to grant him a
hearing and deny the Commonwealth's request that his license be suspended and your Honorable
Court to stay any and all suspensions.

Dear MR. PAOLETTA:
This is an Official Notice of the Suspension of your Driving
Privilege as authorized by Section 1544 of the PennsYlvania
Vehicle Code. As a result of your 06/12/2001 conviction of
violating Section 3362 of the Vehicle Code, EXCEEDING MAXI-
MUM SPEED, on 03/08/2001:
. Your driving privilege is SUSPENDED fo~ a pe~iod of 20
DAY(S) effective 06/20/2001 at 12:01 a.m.
Instead of assigning points to your driver's license record,
Section 1544 of the Vehicle Code requires PennDOT to extend
any existing suspension 5 days for each point that would
have been assigned to your driver's license record. There-
fore, PennDOT is assigning this additional 20 DAY(S) sus-
pension to your current suspension.
This suspension is in addition to any other suspensions al-
ready on your record.
COMPLYING WITH THIS SUSPENSION
PennDOT records indicate that your driving privilege is
currently suspended/revoked. You must return all current
Pennsylvania driver's licenses, learner's permits, tempo-
rary driver's licenses (camera cards) in your possession
IMMEDIATELY.
YOU MAY NOT RETAIN YOUR DRIVER'S LICENSE FOR IDENTIFICATION
PURPOSES. However, You may apply for and obtain a photo
identification card at anY Driver License Center for a cost
of 9.00. You must present two (2) forms of proper iden-
tification (e.g., birth certificate, valid U.S. passport,
marriage certificate, etc.) in order to obtain your photo
identification card.
You will not ~eceive c~edi t towa~d se~ving any suspension
until we ~eceive your license(s). Complete the following
steps to acknowledge this suspension.

1. Return all current Pennsylvania driver's licenses.
learner's permits and/or camera cards to PennDOT. If
yOU do not have any of these items. send a sworn nota-
rized letter stating yOU are aware of the suspension of
your driving privilege. You must specify in your letter
why YOU are unable to return your driver's license.
Remember: You may not retain your driver's license for
identification purposes. Please send these items to:

2. Upon receipt. review and acceptance of your PennsYlvania
driver's licensees). learner's permit(s). camera
card(s). and/or a sworn notarized letter. PennDOT will
send YOU a receipt confirming the date that credit be-
gins. If YOU do not receive a receipt from us within 3
weeks. please contact our office. Otherwise. YOU will
not be given credit toward serving this suspension.

3. If YOU do not return all current driver license pro-
ducts. we must refer this matter to the Pennsylvania
State Police for prosecution under SECTION 157ICa) (4)
of the PennsYlvania Vehicle Code.

You have the right to appeal this action to the Court of
Common Pleas (Civil Division) within 30 days of the mail
date. JUNE 20. 2001. of this letter. I~ you ~ile an appeal
in the County Court, the Court will give yOU a time-stamped
certi~ied copy o~ the appeal. In order for your appeal to
be valid. YOU must send this time-stamped certified copy of
the appeal by certified mail to:
