STIPULATION AGAINST LIENS
THIS AGREEMENT made the 14th of June, 2001, by and between
J. M. CONSTRUCTION, INC., - ~tr(lC.:-\c,
AND
.
WILLIAM E. SWANGER III and TRUDY D. SWANGER, hereinafter referred
to as~wner, whereby the former undertook and agreed to erect and
construct a single family dwelling on that certain lot of ground
situate in
Lot 137, 2203 Hastings Drive, Mechanicsburg, PA., as per attached
legal:
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to J. M. Construction, Inc. in hand paid by Owner, the receipt
whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's
liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.

ALL THAT CERTAIN piece, parcel or lot of land situate in Upper
Allen Township, Cumberland County, Pennsylvania, and bounded and
described as follows:
BEGINNING at a point on the Northern right~of-way line of
Hastings Drive (50.00 feet wide), said point being located at the
Southeastern corner of Lot No. 138; thence along the Eastern
boundary line of Lot No. 138 North 20 degrees (erroneously shown
as 28 degrees on the recorded Final Subdivision Plan) 13 minutes
54 seconds East, and through a 25.00 foot wide drainage easement,
for a distance of 130.00 feet, to a point in line of other lands
now or formerly of The MCNaughton Company; thence along said
lands now or formerly of The MCNaughton Comopany, and along the
centerline of said 25.00 foot wide drainage easement, South 69
degrees 46 minutes 06 seconds East, for a distance of 85.26 feet,
to a point; thence along same South 51 degrees 04 minutes 00
seconds East, for a distance of 17.59 foot to a point at the
Northwestern corner of Lot No. 136; thence along the Western
boundary line of Lot No. 1}6, and through said 25.00 foot wide
drainage easement South 32 degrees 49 minutes 35 seconds West,
for a distance of 131.74 feet, to a point on the Northern
right-of-way line of Hastings Drive (50.00 f~et wide); thence
along said right-of-way line on the arc of a circle curving to
the right, having a radius of 175.00 feet, and an arc length of
38.47 feet, to a point; thence along same North 69 degrees 46
minutes 06 seconds West, for a distance of 35.04 feet, to a point
and the place of BEGINNING.
THIS PIECE, PARCEL or lot of land consists of approximately
11,530 square feet of land, and is known and numbered as Lot No.
137 on the Final Subdivision Plan for Canterbury Estates, Phases
VII and VIII, which is recorded in Cumberland County Plan Book
77, Page 100.
BEING PART OF THE SAME PREMISES which The McNaughton Company,
a Pennsylvania corporation, by their deed to be recorded
simultaneously herewith, in the office of the Recorder of Deeds
of Cumberland County, granted and conveyed unto William W. Swanger
III and Trudy D. Swanger.
