hereinafter refmxed to as Owner,
Whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot
of ground situate in South Middleton Township, Cumberland County, Pennsylvania, containing 2.162 acres
according to a resurvey of land prepared for Harry H. Fox, Jr. by Thomas E. Shelly, Registered Surveyor, and
dated November 1997. Being more fully described in Deed recorded in Cumberland County Deed Book 214,
page 845.
Being further identified as Tax Parcel No. 40-14-0140-013
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of ONE DOLLAR ($1.00) to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about the erection and construction of the said
buildings on the lot above-described, and the said Contractor, for themselves, their subcontractors and others
under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien,
shall be an independent covenant.

ALL THAT CERTAIN tract of woodland situate in the Township of South
Middleton, County of Cumberland, and Commonwealth of Pennsylvania, being more
particularly bounded and described as follows, to wit:
BEGINNING at a comer marked by a rebar and cap which marks the common
point of ajoinder of the within described tract, lands now or formerly of Poust and lands
now or formerly of Charles B. Garman; thence extending along lands now or formerly of
Garman, North 32 degrees 13 minutes 51 seconds East, a distance of 174.31 feet to an
existing rebar and cap at lands now or formerly of John I. Deardorff; thence extending
along lands now or formerly of Deardorff, South 71 degrees 13 minutes 39 seconds East, a
distance of 557.15 feet to an iron pipe at lands now or formerly of Rodney L. Decker, II;
thence extending along said lands, South 32 degrees 19 minutes 17 seconds West, a distance
of 173.50 feet to a comer marked by a pile of stones at lands now or formerly of William
Poust; thence extending along lands now or formerly of Poust, North 71 degrees 18 minutes
54 seconds West, a distance of 557.07 feet to a point marked by a rebar at lands now or
formerly of Charles B. Garman, said point marking the place of BEGINNING.
CONTAINING 2.162 acres according to a resurvey of land prepared for Harry H.
Fox, Jr. by Thomas E. Shelly, Registered Surveyor, and dated November 1997.
