JEFFREY STRICKLAND, : _ !SAS n'1 Lb Defendant MUNICIPAL LIEN FOR SEWER SERVICES North Middleton Authority, North Middleton Township, County of Cumberland, Commonwealth of Pennsylvania by its solicitor, Martson Deardorff Williams Otto Gilroy & Faller, hereby files its claim for sewer services against the real estate hereinafter described and sets forth its claim as follows: STATEMENT OF CLAIM The name of the municipality by which this claim is filed is North Middleton Authority, a municipal authority of the Commonwealth of Pennsylvania, located in the County of Cumberland and organized pursuant to ordinances of North Middleton Township. 2 The name or names of owner or owners or reputed owner or owners, of the property against which this claim is filed is M. Jeffrey Strickland, 102 Partridge Circle, Carlisle, Pennsylvania. 3 A description of the property against which this lien is filed is attached hereto and marked as Exhibit "A" with an address of 623 Creek Road, Carlisle, Pennsylvania. 4 The authorities under and by virtue of which this lien is filed is the Municipal Claims and Liens Act of May 16,1923, P.L. 207, as amended and supplemented, 53 P.S. 7101 et seq. 5 The lien is claimed for unpaid sewer user fees against the above-described property in the amount of $2,674.00. 6 Interest is claimed on the above-mentioned amount from December 21, 2006. BETWEEN Strickland Brothers Construction, LLC, successor in interest to Strickland Brothers Construction, a Pennsylvania general partnership, with offices located in North Middletc x Township, Cumberland County, Pennsylvania, Grantor -AND- NL Jeffrey Strickland, single man, of Carlisle, Cumberland County, Pennsylvania, Grantee WITNESSETH, that in consideration of One Hundred Twenty-five Thousand and 00/100 Dollars ($125,000.00), in hand paid, the receipt whereof is hereby acknowledged, the said Grantor does hereby grant and convey to the said Grantee, his heirs and assigns, ALL THAT CERTAIN tract of land situate in North Middleton Township, Cumberland County, Pennsylvania, bounded and described in accordance with the Final Plan for Arthur R. Klingler Estate recorded September 11, 1974, in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 25, Page 93, as follows, to wit: BEGINNING at an iron pin set on the southern line of the dedicated right of way of Creek Road (Township Road 497) at the northwest comer of Lot No. 8 as designated on the aforementioned Plan; thence by said Lot No. 8 South 20 degrees 16 minutes 40 seconds East, a distance of 197.39 feet to an iron pin set on the northern line of lands now or formerly of Carl W. Lehman; thence by same, South 70 degrees 52 minutes 20 seconds West, a distance of 114.76 feet to an iron pin set on the southeastern comer of Lot No. 6 on said Plan; thence by said Lot No. 6, North 20 degrees 16 minutes 40 seconds West, a distance of 187.30 feet to an iron pin set at the point of intersection of the southern line of the dedicated right of way of said Creek Road with the northeastern corner of said Lot No. 6; thence by said line of said dedicated right of way, North 65 degrees 50 minutes 20 seconds East, a distance of 115.00 feet to an iron pin set at the northwest comer of said Lot No. 8, the point and place of BEGINNING. nox 271 FIG[4447. Lebo), husband and wife, by their Deed dated January 31, 2003, and recorded February 3, 2003, in the Office of the Recorder of Deeds in and for Cumberland County, in Deed Book 255, Page 3048, granted and conveyed unto Strickland Brothers Construction, Grantor herein. SUBJECT, HOWEVER, to such easements, conditions, restrictions and/or other matters of record affecting said premises. AND having satisfied the conditions set forth in the prior Deed between Barry L. Lebo and Carolyn L. Lebo (a/k/a Carolyn E. Lebo) and Strickland Brothers Construction, a Pennsylvania general partnership, recorded in Office of the Recorder of Deeds in and for Cumberland County, in Deed Book 255, Page 3048 dated January 31, 2003, which condition has been satisfied by the properly recorded written certification of Barry L. Lebo and Carolyn L. Lebo (a/k/a Carolyn E. Lebo) in the Office of the Recorder of Deeds in and for Cumberland County simultaneously herewith. AND FURTHER SUBJECT, HOWEVER, to the condition that only such residential buildings as are permitted by applicable governmental ordinances and requirements, which buildings shall be constructed on the site frorr good-quality building materials, shall be erected on the premises, and that no trailers, double-wides, modular or prefabricated structures shall be placed nor erected thereon.
