HAGER, husband and wife Owners Vo HOFFMAN'S CUSTOM CONTRACTING, Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS This instrument is executed this 7q4X'day of May, 2003, by Hoffrnan's Custom Contracting ("Contractor") in favor of Scott M. Hager and Leda S. Hager ("Owners"). Whereas, Owners are about to execute contemporaneously herewith, a contract with Contractor for the erection of a single family dwelling upon a lot of land situate in Dickinson Township, Cumberland County, Pennsylvania, more fully described as follows: ALL THAT CERTAIN tract of land situate in Silver Spring Township, Cumberland County, Pennsylvania, bounded and described according to a Final Subdivision Plan for Roland Dwight Fenton and Dolores A. Fenton prepared by Hoover Engineering Services, Inc., dated January 8, 2002, and revised February 12, 2003, recorded in Cumberland County, Pennsylvania Plan Book 87, Page 22, as follows, to wit: BEGINNING at a point in Biddle Road, T-571, at the southwest comer of Lot 1, land of the Grantors; thence through said Biddle Road, South 59 degrees 29 minutes 03 seconds West 291.18 feet to a point, said point being on the centerline of Old Stonehouse Road, S.R. 2002, intersecting with said Biddle Road, T-571; thence through said Old Stonehouse Road, North 43 degrees 15 minutes 57 seconds West 157.95 feet to a point in said Old Stonehouse Road; thence through said Old Stonehouse Road and along said Lot 1, land of the Grantors, North 40 degrees 20 minutes 57 seconds East 27.06 feet to a proposed concrete monument; thence along said Lot 1 the following four (4) courses and distances: (1) North 28 degrees 07 minutes 41 seconds West 104.65 feet to an iron pin to be set; (2) North 36 degrees 22 minutes 56 seconds East 248.95 feet to an iron pin to be set; (3) North 50 degrees 26 minutes 32 seconds East 67.40 feet to a point; and (4) South 30 degrees 30 minutes 57 seconds East 374.42 feet to a point, the point and place of BEGINNING. BEING Lot 2 on the Final Subdivision Plan for Roland Dwight Fenton & Dolores A. Fenton and containing 2.2804 acres. BEING a portion of the premises which Roland Dwight Fenton and Dolores A. Fenton, by their Deed dated June 26, 1991 and recorded in Cumberland County, Pennsylvania Deed Book "E," Volume 35, Page 1076, granted and conveyed unto Roland Dwight Fenton and Dolores A. Fenton, Grantors herein. Now, May 'Q~ _.. , 2003, at the time of and immediately before the execution of the construction contract aforesaid, and before any authority has been given by the said Scott M. Hager and Leda S. Hager to the said Hoffman's Custom Contracting to commence work on the said building, or purchase materials for the same, in consideration of the Owners making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Witness, our hand and seals the day and year aforesaid. Hoffrnan, known to me to be the person whose name is subscribed, and who acknowledges himself to be the President of Hoffman's Custom Contracting, a Pennsylvania corporation, and that he as such President, being authorized to do so, executed the foregoing statement for the purposes therein contained by signing the name of the corporation by himself as such officer.
