Complaint
1. The Plaintiff is American Express Travel Related Services Company, Inc. (hereafter
"American Express") with place of business located at American Express Tower, World
Financial Center, New York, New York.
2. The Defendant Gary Jaster (hereafter "Jaster") is an individual, who resides at 6407
Lexington Drive, Mechanicsburg, Cumberland County, Pennsylvania.
3. The Defendant Kandersteg Incorporated d/b/a Kandersteg, Inc. (hereafter
"Kandersteg") does business at 4067 Market Street, Suite 200, Camp Hill, Cumberland County,
Pennsylvania.
4. At all relevant times, American Express was and is a corporation organized and
existing under the laws of the State of New York
5. Jaster and Kandersteg, by and through its agent and authorizing officer Jaster, applied
for and were given the American Express Business Platinum Card, which enabled Kandersteg
and Jaster to charge items to an American Express Business Platinum Card Account Number
372720009352009.
6. At all relevant times, Jaster was the holder of a Business Platinum Cazd that enabled
him to charge items to the Business Platinum Account.
7. At all relevant times, Jaster was the basic cazdmember on the Business Platinum
Account and was responsible for paying all amounts chazged to the Business Platinum Account
as he applied for the account as the authorizing officer.
8. By accepting and using the Business Platinum Card, Jaster and Kandersteg agreed to
all of the terms and conditions set forth in the Business Platinum Cazd Agreement, including the
following:
a. Jaster agreed that as the "Authorizing Officer" he is jointly and severally liable
for all amounts chazged to the Business Platinum Account.
b. Kandersteg agreed to be jointly and severally liable for all amounts charged to
the Business Platinum Account.
c. Jaster and Kandersteg agreed that payment for all chazges to the Business
Platinum Account is due by the payment due date indicated on the monthly billing statements
mailed by or on behalf of American Express.
d. Jaster and Kandersteg agreed that if the payment was not made by the payment
due date indicated on the monthly billing statements, American Express may assess additional
fees per the terms of the agreement.
e. Jaster and Kandersteg agreed that in the event of default, they would pay all
reasonable costs, including reasonable attorney's fees incurred by American Express in
collecting the balance due including finance chazges and delinquency fees and in protecting
themselves from any harm they may suffer as a result of the default.
9. The Business Platinum Agreement was provided to Jaster and Kandersteg with the
Business Platinum Card, and a true and correct copy of the Business Platinum Agreement is
attached hereto and incorporated herein as Exhibit A.
10. Jaster and Kandersteg used the Business Platinum Card to charge various items to the
Business Platinum Account.
11. American Express issued and sent to Jaster and Kandersteg the Business Platinum
Statements, which set forth in detail all items charged to the Business Platinum Account and the
total amount due and owing by Jaster and Kandersteg to American Express.
Count 1 -American Express v. Jaster -Breach of Contract
12. American Express incorporates by reference the averments of paragraphs one through

13. Jaster failed to pay the balance in full specified on the Business Platinum Account
statements.
14. By reason of the foregoing, Jaster breached the Business Platinum Agreement with
American Express.
15. As a result of the breach, Jaster is liable to American Express for the sum of
$25,442.43.
16. Despite due demand, Jaster has failed and refused to pay American Express any
portion of the amount due and owing.
17. As a result of Jaster's failure to pay the amount that he owes, American Express
referred its claim to outside attorneys for collection and is entitled to collect reasonable
attorney's fees from Jaster.
18. By reason of the foregoing, American Express is entitled to judgment against Jaster
for breach of contract in the sum of $25,442.43, plus reasonable attorney's fees, costs and
prejudgment interest.
WHEREFORE, American Express demands judgment against Jaster on Count 1 in the
sum of $25,442.43 plus reasonable attorney's fees, costs and prejudgment interest.
Count 2 -American Ezpress v. Jaster -Account Stated
19. American Express incorporates by reference the averments of paragraphs one through

20. Jaster used the Business Platinum Card to charge various items to the Business
Platinum Account for which payment was never made. American Express kept accurate records
of all debits and credits to the credit Business Platinum Account.
21. American Express mailed to Jaster monthly billing statements for the Business
Platinum Account, which accurately stated the previous balance, the debits and credits to the
Business Platinum Account for the prior billing period.
22. Jaster had for many months made payments on account of the billing statements or
retained the statements without payment.
23. Jaster's actions as set forth above constituted an account stated between the parties
for the sum of $25,442.43, which sum reflects the balance, less credits, if any, which were
applied prior to the date of this Complaint.
Wherefore, American Express demands judgment against Jaster on Count 2 in the sum of
$25,442.43 plus prejudgment interest and costs.
Count 3 -American Ezpress v. Jaster -Unjust Enrichment
24. American Express incorporates by reference the foregoing paragraphs one through 23.
25. As a result of the foregoing, faster received the benefit of American Express's
extension of credit in the amount of $25,442.43 without paying for same.
26. faster was aware of, apprehended and appreciated American Express's provision of
credit by reason of his having made payments on account of the Business Platinum Account
statements received on and after he opened the account.
27. The reasonable value of the credit American Express provided faster is the sum of
$25,442.43.
28. American Express is entitled to prejudgment interest on the outstanding balance from
the date of this Complaint.
29. American Express believes and avers if the relief requested herein is not granted,
faster will be unjustly enriched at American Express' expense.
WHEREFORE, American Express demands judgment against faster on Count 3 in an
amount to be determined at trial plus prejudgment interest and costs.
Count 4 -American Express v. Kandersteg -Breach of Contract
30. American Express incorporates by reference the averments of paragraphs one through

31. Kandersteg failed to pay the balance in full specified on the Business Platinum
Account statements.
32. By reason of the foregoing, Kandersteg breached the Business Platinum Agreement
with American Express.
33. As a result of the breach, Kandersteg is liable to American Express for the sum of
$25,442.43.
34. Despite due demand, Kandersteg has failed and refused to pay American Express any
portion of the amount due and owing.
35. As a result of Kandersteg's failure to pay the amount that it owes, American Express
referred its claim to outside attorneys for collection and is entitled to collect reasonable attorney's
fees from Kandersteg
36. By reason of the foregoing, American Express is entitled to judgment against
Kandersteg for breach of contract in the sum of $25,442.43, plus reasonable attorney's fees, costs
and prejudgment interest.
WHEREFORE, American Express demands judgment against Kandersteg on Count 4 in
the sum of $25,442.43 plus reasonable attorney's fees, costs and prejudgment interest.
Count 5 -American Express v. Kandersteg -Account Stated

Business Platinum Account for the prior billing period.

41. Kandersteg's actions as set forth above constituted an account stated between the
parties for the sum of $25,442.43, which sum reflects the balance, less credits, if any, which were
applied prior to the date of this complaint.
Wherefore, American Express demands judgment against Kandersteg on Count 5 in the
sum of $25,442.43 plus prejudgment interest and costs.
Count 6 -American Express v. Kandersteg -Unjust Enrichment
42. American Express incorporates by reference the foregoing paragraphs one through 41.
43. As a result of the foregoing, Kandersteg received the benefit of American Express's
extension of consumer credit in the amount of $25,442.43 without paying for same.
44. Kandersteg was aware of, apprehended and appreciated American Express's provision
of credit by reason of its having made payments on account of the Business Platinum Account
statements received on and after it opened the account.
45. The reasonable value of the credit American Express provided Kandersteg is the sum
of $25,442.43.
46. American Express is entitled to prejudgment interest on the outstanding balance from
the date of this complaint.
47. American Express believes and avers if the relief requested herein is not granted,
Kandersteg will be unjustly enriched at American Express's expense.
WHEREFORE, American Express demands judgment against Kandersteg on Count 6 in
