The Plaintiff, Nicole Nestlerode, is an adult individual residing at 496 South Nursery Drive, Mechanicsburg, Cumberland County, Pennsylvania. 2. The Defendant, Scott Cady, is an adult individual residing at 1714-A Market Street, Camp Hill, Cumberland County, Pennsylvania. 3. The Plaintiff seeks primary custody of the following child: NAME PRESENT RESIDENCE DATE OF BIRTH Taylor Cady 496 South Nursery Drive June 28, 1998 Mechanicsburg, PA The child was born out of wedlock. The child is presently in the custody of Plaintiff who resides at 496 South Nursery Drive, Mechanicsburg, Cumberland County, Pennsylvania. She is married. The father of the child is Scott Cady, currently residing at 1714-A Market Street, Camp Hill, Cumberland County, Pennsylvania. He is not married. 2 4. The relationship of Plaintiff to the child is natural mother. The Plaintiff currently resides with the following persons: NAME a. Nicole Nestlerode RELATIONSHIP mother b. Alexandria Hart half sister 5. The relationship of Defendant to the child is that of natural father. The Defendant currently resides with the following persons: NAME a. Courtney (Surname Unknown) b. Serenity (Surname Unknown) RELATIONSHIP girlfriend girlfriend's daughter 6. Plaintiff has not participated as a party or witness, or in another capacity, in other litigation concerning the custody of the child in this or another Court. Plaintiff has no information of a custody proceeding concerning the child pending in a Court of this Commonwealth. Plaintiff does not know of a person not a party to these proceedings who has physical custody of the child or claims to have custody or visitation rights with respect to the child. 3 7. Over the past seven (7) yeazs, Plaintiff has been the primazy cazetaker of the child and Defendant has, in an informal manner without an Order of Court, exercised periods of partial custody as mutually agreed upon by the parties averaging one (1) full weekend day with the child staying overnight and a visit during the week lasting three (3) hours. 8. The Defendant's circumstances over the past several months have changed, which has given Plaintiff concern that on-going regulaz periods of partial custody will be able to be effected in the future. 9. The best interest and permanent welfaze of the child will be served by granting the relief requested because the Plaintiff has been the primary caretaker of the child, can provide a stable, safe, and secure environment and can provide for the child's emotional, psychological and spiritual needs. Further, the child views the Plaintiff as a source of stability, a source of love, and a source of emotional support. 10. Each parent whose pazental rights to the child have not been terminated and the person who has physical custody of the child have been named as parties to this action. All other persons, named below, who aze known to have or claim a right to custody or visitation of the child have been given notice of the pendency of this action and the right to intervene: None. 4 WHEREFORE, Plaintiff, Nicole Nestlerode, requests the Court to grant primary custody of the child to the Plaintiff and grant Defendant, Scott Cady, rights of partial physical custody. The mother, Nicole Nestlerode, and the father, Scott Cady, shall enjoy shared legal custody of Taylor A. Cady, born June 28,1998. The mother shall enjoy primary physical custody of the minor child. The father shall enjoy periods of temporary physical custody of the minor child as follows: A. On alternating weekends from Friday evening until Sunday evening pursuant to a time agreed upon by the parties for delivery and pick up. B. On at least one evening during the week pursuant to a schedule as agreed upon by the parties. C. At such other times as agreed upon by the parties. Each party shall also have the ability to take the minor on a summer vacation under circumstances similar to what the parties have done in the past. 6. Both parties shall insure that neither party or any other adult in their company disparages the other parent to the minor child or any way interferes with the love and affection the minor child may have for the other parent. 7. This Order is entered pursuant to an agreement reached by the parties at a Custody Conciliation Conference.
