CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE And now comes Nationstar Mortgage, LLC flk/a Centex Home Equity Company, LLC, by its attorneys, James, Smith, Dietterick & Connelly, LLP and files this Complaint in Mortgage Foreclosure as follows: 1. The Plaintiff is Nationstar Mortgage, LLC flk/a Centex Home Equity Company, LLC, which has its principal place of business at 350 Highland Drive, Lewisville, Texas 75067. 2. The Defendants, Timothy M. Harry and Camille C. Harry, are individuals whose last known address is 1136 Ashton Drive, Shippensburg, Pennsylvania 17257. 3. On or about November 2,2006, Defendant, Camille C. Harry, executed a Note in favor of Plaintiff in the original principal amount of$89,000.00. 4. On or about November 2, 2006, as security for payment of the aforesaid Note, Defendants made, executed and delivered to Plaintiff a Mortgage in the original principal amount of $89,000.00 on the premises hereinafter described, with said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on November 8,2006, in Mortgage Book Volume 3309, Page 345. A true and correct copy of said Mortgage containing a description of the mortgaged premises is marked Exhibit "A", attached hereto and made a part hereof. 5. Defendants are the record and real owners of the aforesaid mortgaged premises. 6. Defendants are in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installments of principal and interest when due. 7. On or about February 8,2007, Defendants were mailed combined Notices of Homeowners' Emergency Mortgage Assistance Act of 1983 and Notices ofIntention to Foreclose Mortgage, in compliance with the Homeowner's Emergency Mortgage Assistance Act, Act 91 of 1983 and Act 6 of1974, 41 P.S. ~101, et seq. 8. The amount due and owing Plaintiffby Defendants is as follows: Principal Interest through 3/21/07 Late Charges Plaintiff Advances Attorneys' fees Court, Sheriff and Title Costs $89,000.00 $ 2,561.00 $ 127.88 $ 20.00 $ 1,250.00 $ 2,500.00 TOTAL $95,458.88 plus interest on the principal sum ($89,000.00) from March 21,2007, at the rate of$18.97 per diem, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises. WHEREFORE, Plaintiff demands judgment in mortgage foreclosure for the amount due of$95,458.88, with interest thereon at the rate of$18.97 per diem from March 21, 2007, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises.
