I. Plaintiff is an individual residing at the address above giv(:n.
2. Defendant is a business entity with an office located at the address above given.
3. At all times relevant hereto, defendant owned, controlled, and/or was responsible for
the maintenance and upkeep of a property known as Texaco Foodmart and situate at
36-35 Simpson Ferry Road and/or East Main Seet, Camp Hill, Pennsylvania and the
sidewalks and walkways adjacent thereto.
4. On or about May 4, 2001, and for a considerable time prior thereto there existed on
the walkway adj acent to the above referenced premises a certain condition which
presented a hazard and danger to those individuals who had occasion to walk on said
sidewalk.
5. It was the duty and obligation of the defendant and by and through its agents, servants
and/or employees, to keep and maintain said walkway in a proper and safe condition.
6. Despite said duty and obligation, defendant by and through its agents, servants and lor
employees allowed said dangerous and hazardous condition to be and remain at the
point aforesaid for an unreasonable period of time.
7. Defendant by and through its, servants and employees knew or should have known of
the existence of said dangerous and hazardous condition at the point aforesaid.
8. On or about May 4, 200 I, while plaintiff was a lawful business invitee of Defendant
walking on the walkway adjacent to the aforementioned premises, he tripped and fell
as a result of the aforementioned dangerous and hazardous condition, and as a result
thereof, suffered injuries and damages as hereinafter more fully set forth.
9. The accident occurred solely as a result of the carelessness, recklessness, and
negligence ofthe defendant and was due in no manner whatsoever to any act or
failure to act on the part of the plaintiff.
10. The carelessness, recklessness, and negligence of the defendant consisted of:
(a) Failing to act with regard to the rights, safety arid position of the plaintiff;
(b) Failing to keep and maintain said sidewalk in a proper and safe condition:
(c) Failing to warn the public in general and the plaintiff in particular of the
existence of said dangerous and hazardous condition;
(d) Failing to place barriers so as to protect the public in general and the
plaintiff in particular from said dangerous and hazardous condition.
(e) Allowing said dangerous and hazardous condition to be and remain at the
point aforesaid for an unreasonable period of time:
(f) Violations of the statutes of the Commonwealth of Pennsylvania and local
ordinances; and
(g)
11. As a result of the aforesaid, Plaintiff suffered, Post Traumatic Injury to the Knees,
severe shock and damage to his nerves and nervous system, as well as other
conditions over his body and extremities, all of which may be permanent in nature
and which caused and will continue to cause Plaintiff to suffer great pain and mental
anguish, to his damage and loss.
12. As a further result of the aforesaid, Plaintiff has and may :in the future be hindered and
prevented from attending to his usual and daily duties andl occupations, and has and
may in future experience great pain and mental anguish, to his damage and loss.
13. As a further result of the aforesaid, Plaintiff has and may in the future be forced to
large and various sums of money in endeavoring to treat ,md cure himself of the
aforesaid injuries, to his damage and loss.
WHEREFORE, Plaintiff demands judgment against the Defendants in an amount of
money in excess of Fifty Thousand ($50,000) Dollars.

DEFENDANT'S PRELIMINARY OBJECTIONS TO PLAINTIFF'S COMPLAINT
1. On or about October 6, 2003, Plaintiff filed a Complaint, alleging personal injuries
as a result of a fall which occurred on May 4, 2001.
2. The Complaint alleges that the Plaintiff was causl~d to fall as a result of a dangerous
condition on the Defendant's property.
3. Nowhere in Plaintiff's Complaint does Plaintiff describe in any manner the allegedly
dangerous condition.
4. The Complaint is, therefore, impermissibly vague and does not advise Defendant of
the basis of the allegations of negligence.
WHEREFORE, Defendant requests that this Court orde'r Plaintiff to file a more specific
pleading, specifically identifYing the allegedly dangerous condition which caused Plaintiff to fall.

AMENDED COMPLAINT -CIVIL ACTION
1. Plaintiff is an individual residing at the address above given.
2. Defendant is a business entity with an office located at the address above given.
3. At all times relevant hereto, defendant owned, controlled, and/or was responsible for
the maintenance and upkeep of a property known as Texaco Foodmart and situate at
36-35 Simpson Ferry Road and/or East Main Seet, Camp Hill, Pennsylvania and the
sidewalks and walkways adjacent thereto.
4. On or about May 4,2001, and for a considerable time prior thereto there existed on
the walkway adjacent to the above referenced premises a certain condition which
presented a hazard and danger to those individuals who had occasion to walk on said
sidewalk. This condition was caused by the defendant as they blocked the walkway to

an entrance to the store by placing, or allowing to be placed boxes of merchandise for
sale that made it impossible for the plaintiff to safely exit the store.
5. It was the duty and obligation of the defendant and by and through its agents, servants
andlor employees, to keep and maintain said walkway in a proper and safe condition.
6. Despite said duty and obligation, defendant by and through its agents, servants and lor
employees allowed said dangerous and hazardous condition to be and remain at the
point aforesaid for an unreasonable period of time.
7. Defendant by and through its, servants and employees knew or should have known of
the existence of said dangerous and hazardous condition at the point aforesaid.
8. On or about May 4,2001, while plaintiff was a lawful business invitee of Defendant
walking on the walkway adjacent to the aforementioned premises, he tripped and fell
as a result ofthe aforementioned dangerous and hazardous condition, and as a result
thereof, suffered injuries and damages as hereinafter more fully set forth.
9. The accident occurred solely as a result of the carelessness, recklessness, and
negligence of the defendant and was due in no manner whatsoever to any act or
failure to act on the part ofthe plaintiff.
10. The carelessness, recklessness, and negligence of the defendant consisted of:
(a) Failing to act with regard to the rights, safety and position of the plaintiff;
(b) Failing to keep and maintain said sidewalk in a proper and safe condition:
(c) Failing to warn the public in general and the plaintiff in particular of the
existence of said dangerous and hazardous condition;
(d) Failing to place barriers so as to protect the public in general and the
plaintiff in particular from said dangerous and hazardous condition.
(e) Allowing said dangerous and hazardous condition to be and remain at the
point aforesaid for an unreasonable period of time:
(f) Violations of the statutes of the Commonwealth of Pennsylvania and local
ordinances; and
(g)
11. As a result of the aforesaid, Plaintiff suffered, Post Traumatic Injury to the Knees,
severe shock and damage to his nerves and nervous system, as well as other
conditions over his body and extremities, all of which may be permanent in nature
and which caused and will continue to cause Plaintiff to suffer great pain and mental
anguish, to his damage and loss.
12. As a further result of the aforesaid, Plaintiff has and may in the future be hindered and
prevented from attending to his usual and daily duties and occupations, and has and
may in future experience great pain and mental anguish, to his damage and loss.
13. As a further result ofthe aforesaid, Plaintiff has and may in the future be forced to
large and various sums of money in endeavoring to treat and cure himself of the
aforesaid injuries, to his damage and loss.
WHEREFORE, Plaintiff demands judgment against the Defendants in an amount of
money in excess of Fifty Thousand ($50,000) Dollars.

1. After reasonable investigation, the Answering Defendant is without knowledge or
information sufficient to form a belief as to the truth or falsity of the averments contained in this
paragraph.
2. Denied. Defendant does not have an office at that location, but does have a place of
business. It is also denied that the address given is correct. The correct address is 3635 Simpson
Ferry Road, Camp Hill, PA 17011.
