WHEREAS, Silvo D. Lupachino and Jeannette M. Lupachino of
Mechanicsburg, Pennsylvania (herein "Owners") has entered into a contract, with Alan
L. Hellam, Contractor, of Mechanicsburg, Cumberland County, Pennsylvania (herein
"Contractor"), for the erection of a dwelling upon Lot 202, Dada Road, Mechanicsburg,
Cumberland County.
NOW, May ~ 2003, at the time of and immediately before
construction pursuant to such principal contract, and before any authority has been
given by the said Owners Silvo D. Lupachino and Jeannette M. Lupachino to the said
Allan L. Hellam, Contractor, to commence work on the said building, or purchase
materials for the same in consideration of the making of the said contract with Silvo D.
Lupachino and Jeannette M. Lupachino, Owners, and the further consideration of One
($1.00) Dollar in hand paid to Contractor by Owners Silvo D. Lupachino and Jeannette
M. Lupachino, it is agreed that no lien shall be filed against the building by the
Contractor, or any sub-contractor, nor by any of the material-men or workmen or any
other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL THAT CERTAIN piece or parcel of land situate in the Borough
of Mechanicsburg, County of Cumberland and State of Pennsylvania, bounded
and described as follows, to wit:
BEGINNING at a point on the Western line of Dada Road, said
point being at the dividing line between Lots Numbers 201 and 202 on the
hereinafter mentioned Plan of Lots; thence along said dividing line, South 73
degrees 13 minutes West, One Hundred Ten (110) feet to a point; thence North
16 degrees 47 minutes West, Eighty (80) feet to a point; thence North 73
degrees 13 minutes East, One Hundred Ten (110) feet to a point on the Western
line of Dada Road; thence continuing along the Western line of Dada Road South
16 degrees 47 minutes East, Eighty (80) feet to a point, the place of
BEGINNING.
BEING Lot Number 202 on Plan Number 7, Plot "B", Heritage
Acres, said Plan being recorded in the Cumberland County Recorder's Office in
Plan Book 24, Page 93.
BEING the same premises which Eugene C. Fleming, Jr. and Sue
W. Fleming, husband and wife, by their deed dated December 21, 2002 and
recorded January 9, 2003, and recorded in the Office of the Recorder of Deeds in
and for Cumberland County, in Deed Book 255, Page 1346, granted and
conveyed unto Alan L. Hellam and Kathleen M. Hellam, husband and wife, in fee.
