MUELLER, M.D. : CIVIL ACTION Defendant : : COMPULSORY ARBITRATION COMPLAINT 1. Plaintiff, MILLER & ASSOCIATES, PC, is a Pennsylvania professional corporation with its principal office located at 1822 Market Street, Camp Hill, Cumber- land County, Pennsylvania (hereinafter referred to as the "Plaintiff'). 2. Plaintiff is in business as a law firm. 3. Defendant, SCOTT D. MUELLER, M.D., is an adult individual with a business address of 2025 Technology Parkway, Suite 205, Mechanicsburg, Hampden Township, Cumberland County, Pennsylvania 17050-9402 (hereinafter referred to as the "Defendant,). Defendant is in business as a general practice physician. COUNT I 5. Plaintiff repeats and reiterates Paragraphs 1 through 4 as set forth herein. 6. On or about February 2000, Plaintiff entered into an agreement with Defendant whereby the parties agreed that Plaintiff would provide legal services to the Defendant on Defendant's legal matters. 7. Upon the request of Defendant, Plaintiff provided legal services to Defendant and incurred costs in the course of its representation of Defendant during the period from on or about February 2000 through on or about October 2000 in the amount of Thirteen Thousand Eight Hundred Eighty-Three and 47/100 Dollars ($13,883.47). 8. Defendant has made payments on account for such legal services and costs in the amount of Five Thousand Five Hundred Twenty-Eight and 20/100 Dollars ($5,528.20). 9. There remains unpaid an amount of Eight Thousand Four Hundred Ninety-Four and 98/100 Dollars ($8,494.98) representing the principal balance owed and accrued interest. 10. The legal services and incurred costs were furnished with the request, knowledge and consent of the Defendant. 11. Plaintiff has made a demand for payment from Defendant. 12. Despite demand for payment, Defendant has refused to make payment for the balance due for the legal services rendered, costs incurred and interest accrued. 13. Defendant has derived a benefit from the legal services rendered and costs incurred by Plaintiff. WHEREFORE, Plaintiff, MILLER & ASSOCIATES, PC, demands judgment against Defendant SCOTT D. MUELLER, M.D., in the sum of Eight Thousand Four Hundred Ninety-Four and 98/100 Dollars ($8,494.98), continuing interest, costs and expenses of this suit, reasonable attorneys' fees and such other relief as this Court may grant. -2- COUNT II 14. Paragraphs 1 through 11 above are herein incorporated by reference and made a part hereof. 15. Upon the request of Defendant, Plaintiff provided legal services to Defendant and incurred costs in the course of its representation of Defendant during the period from on or about February 2000 through on or about October 2000 in the amount of Thirteen Thousand Eight Hundred Eighty-Three and 47/100 Dollars ($13,883.47). 16. Plaintiff has sent statements of account to Defendant. 17. Defendant has not objected to the statements of account. 18. Defendant made payments on account in the amount of Five Thousand Five Hundred Twenty-Eight and 20/100 Dollars ($5,528.20). 19. Defendant has disregarded the statements sent and there remains unpaid an amount of Eight Thousand Four Hundred Ninety-Four and 98/100 Dollars ($8,494.98) representing the principal balance owed and accrued interest. WHEREFORE, Plaintiff, MILLER & ASSOCIATES, PC, demands judgment against Defendant SCOTT D. MUELLER, M.D., in the sum of Eight Thousand Four Hundred Ninety-Four and 98/100 Dollars ($8,494.98), continuing interest, costs and expenses of this suit, reasonable attorneys' fees and such other relief as this Court may grant. -3- 20. Paragraphs I through 19 above are herein incorporated by reference and made a part hereof. 21. Upon the request of Defendant, Plaintiff provided legal services to Defendant and incurred costs in the course of its representation of Defendant during the period from on or about February 2000 through on or about October 2000 in the amount of Thirteen Thousand Eight Hundred Eighty-Three and 47/100 Dollars ($13,883.47). 22. Defendant accepted the legal services rendered and costs incurred by Plaintiff and has derived a benefit therefrom. 23. Defendant made payments in the amount of Five Thousand Five Hundred Twenty-Eight and 20/100 Dollars ($5,528.20). 24. Defendant has disregarded the statements sent and there remains unpaid an amount of Eight Thousand Four Hundred Ninety-Four and 98/100 Dollars ($8,494.98) representing the principal balance owed and accrued interest. 25. Defendant has been unjustly enriched in accepting the legal services rendered and costs incurred by Plaintiff, but failing to make payment therefore to the Plaintiff. WHEREFORE, Plaintiff, MILLER & ASSOCIATES, PC, demands judgment against Defendant SCOTT D. MUELLER, M.D., in the sum of Eight Thousand Four Hundred Ninety-Four and 98/100 Dollars ($8,494.98), continuing interest, costs and expenses of this suit, reasonable attorneys' fees and such other relief as this Court may grant.
