Custer, are about to execute contemporaneously herewith a contract with Custer Homes, Inc. of 2805 Old Post Road, Suite 200, Harrisburg, Dauphin County, Pennsylvania 17110, for the construction ofa single-family model home upon a lot of land situate in Silver Spring Township, Cumberland County, Pennsylvania, being designated as Lot No. 47, Sterling Glen. See Exhibit "A". NOW, mt,:l V-~ ~ f)--f'" , 2007, at the time of and immediately before execution of the principal contract, and before any authority has been given by The Custer Company, Stan Custer, Jr. and Nancy B. Custer to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Custer Homes, Inc. and the further consideration of One Dollar to Custer Homes, Inc. paid by The Custer Company, Stan Custer, Jr. and Nancy B. Custer, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchases, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. EXHIBIT "A" All THAT CERTAIN piece or parcel of land situate in Silver Spring Township, Cumberland County, Pennsylvania, being known and numbered as Lot No. 47 on the Final Subdivision and Land Development Plan for Sterling Glen, said Plan dated January 17, 2002 and recorded in the Office of the Recorder of Deeds of Cumberland County on May 29, 2002 in Cumberland County plan Book 85, Page 67, and as more particularly bounded and described as follows, to wit: BEGINNING at a point of the dividing line between Lot No. 47 and Lot No. 48 on the right-of-way of Sterling Glen Way as appearing on the aforesaid Plan; thence continuing along the dividing line between Lot No. 47 and Lot No. 48, South 84 degrees 31 minutes 52 seconds East for a distance of 187.23 feet to a point at the dividing line between Lot No, 47 and Lot No. 46 as appearing on the aforesaid Plan; thence continuing along the dividing line of Lot No. 47 and Lot No. 46 as appearing on the aforesaid Plan, South 7 degrees 4 minutes 30 seconds East for a distance of 88.01 feet to a point on the right-of-way of Springdale Way; thence continuing along the right-of-way of Springdale Way South 83 degrees 9 minutes 47 seconds West for a distance of 173.81 to another point on Springdale Way at the beginning of a curve; thence continuing along a curve at the intersection of Springdale Way and Sterling Glen Way said curve having a radius of 21 feet and an arc length of 30.52 feet to a point at the right-of-way of Sterling Glen Way; thence continuing along the right-of-way of Sterling Glen Way North 13 degrees 33 minutes 28 seconds West for a distance of 55.89 feet to another point at the beginning of a curve on Sterling Glen Way; thence continuing along a curve on Sterling Glen Way said curve having a radius of 50 feet and an arc length of 226.85 feet to another curve on the right-of-way of Sterling Glen Way; thence continuing along another curve on the right-of-way of Sterling Glen Way said curve having a radius of 125 feet and an arc length of 44.41 feet to a point at the place of BEGINNING.
