STIPULATION AGAINST LIENS
THIS AGREEMENT made this ~~ day of ;w~~2001, by and
between YANER CIISTOM HOMES, INC., herein ter referred to as
Contractor,
AND
MICHAEL L. MIGPiTULSRI AND SALLY T. MIGATULSRI, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in South Middleton Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
#135 Indian Hills, Section 1, South Middleton Township, Cumberland
County, PA.

NOW THEREFORE, THIS AGREEMENT WITNESSETH: '"'°
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

the undersigned officer, personally appeared Michael L. Migatulski
and Sally T. Migatulski, husband and wife, known to me (or
satisfactorily proven) to be the person whose name is subscribed
to the within instrument, and acknowledged that she executed the
same for the purposes therein contained.

Exhibit A
All THAT certain tract of land situate in South Middleton Township, Cumberland
County, Pennsylvania, and more particularly ident~ed as follows:
BEING Lot No. 135 on the >~nal Subdivision Plan of Indian Hills, Section I,
recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book 67, Page 36.
BEGINNING at a point along the right of way line of Crape Myrtle Drive 50 feet
right of way) on the dividing line of Lot No. 134 and Lot No. 135 of the
aforementioned Plan; thence along said dividing line North 86 degrees 55 minutes
45 seconds West a distance of 127.42 feet to a point; thence North 03 degrees 04
minutes 15 seconds East a distance of 134.95 feet to a point on the right of way line
of Hope Drive (50 feet right of way); thence along said Hope Drive south 86 degrees
55 minutes 45 seconds East a distance of 112.42 feet to a point; thence on a curve to
the right, having a radius of 15.00 feet and an arc length of 23.56 feet to a point on
the right of way line of Crape Myrtle Drive (50 feet right of way); thence along said
Crape Myrtle Drive South 03 degrees 04 minutes 15 seconds West a distance of
119.95 feet to a point at the dividing line of Lot No. 134 and Lot No. 135, the point
and place of BEGINNING.
