STIPULATION AGAINST LIENS
THIS AGREEMENT made this lq' dayof ~J~L~y ,2003, byand
between HOFFMAN CUSTOM CONTRACTING hereinafter referred to as Contractor,
and RANDY S. PATTERSON and CHERI K. PATTERSON, hereinafter referred to as
Owners, whereby the former undertook and agreed to erect and construct a single
dwelling house on that certain lot of ground situate at 1164 MCCLURES GAP ROAD,
CARLISLE, North Middleton Township,
description of which is attached hereto.

NOW THEREFORE, THIS AGREEMENT WlTNESSETH; that the said
Contractor, for and in consideration of the sum of One ($1.00) Dollar to the Contractor,
in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further
consideration mentioned in this Agreement aforesaid for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and the lot of ground appurtenant thereto for or on account of
any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in or about the erection and construction of the said buildings on
the lot above described, and the said Contractor, for themselves, their subcontractors
and others under them hereby expressly waive and relinquish the right to have, file and
maintain any mechanic's lien or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be an independent covenant.

BEGINNING at an existing Parker Kalon nail in S. R. 4027 (McClure's Gap Road); thence

distances: South 25 degrees 57 minutes 17 seconds Wcst 25. ! 0 feet to the dedicated right-of-way
line of S. R. 4027; South26 degrees 19 minutes 42 seconds West the loll'owing distances; 212.84
feet to an iron pin set; 140 feet to an iron pin set; and 160 feet to an existing iron pin; and South
50 degrees 24 minutcsl4 seconds East 300 feet to an existing iron pin; thence by land; now or
formerly of William I. and Diane L. Spencer, South 39 dcgrees 58 minutes 53 seconds West
308.45 feet to an iron pin set; thence by Lot No. 1, the residual area being retained by the
Grantors herein, North 44 degrees 12 minutes 54 seconds Wcst the following distances; 375 feet
to an iron pin set; 325 feet to an iron pin set; 249.13 feet to an iron pin set; and 25.23 feet to an
iron pin set; thence along the center line of a proposed 50 toot right-of-way the following
courses and distances; North 38 degrees 02 minutes 50 seconds East 116.76 feet to a stake set;
North 58 degrees 27 minutes 07 seconds East 159.43 feet to an iron pin set; North 61 degrees 09

East 319.31 feet to a railroad spike set in atbresaid S. R. 4027; thence along the center line of
S.R. 4027 by a curve having a radius of 1232.07 feet and a length of 309.67 feet; thence along
the center line of S.R. 4027 South 58 degrees 57 minutes 21 seconds East 41.56 feet to an
existing Parker Kalon nail in S.R. 4027, the place of BEGINNING.
CONTAINING 10.52 acres and being Lot No. 5 as show on the final subdivision plan for
Melvin E. Kelley, Sr. and Theh-na L. Kelley recorded in the Office of the Recorder of Deeds, in
and for Cumberland County, Pennsylvania, at Plan Book 67 Page 46.
BEING the same pIemises which Melvin E. Kelley, Sr. and Thelma L. Kelley, his wife, by their
deed dated November 8, 1994, and recorded in the Office of the Recorder of Deeds, Cumberland
County, Pennsylvania, in Deed Book 114, Page 671 granted and conveyed to Cheri K. Patterson
and Randy S. Patterson, her husband.
