Lauer, Jr., in the person of Matthew J. Eshelman, Esquire, brings the following Complaint, and in support thereof, avers as follows: The Plaintiff is Debra K. Elam, an adult individual residing at 1826 Heishman Gardens, Carlisle, Cumberland County, Pennsylvania 17013. 2. The Defendant is Rashaan, an adult individual believed to be residing at 652 Oakville Road, Shippensburg, Pennsylvania 17257. As of the date of filing of the initial District Justice Complaint, Apri130, 2001, the Defendant's address was in Cumberland County, Pennsylvania. 4. The Defendant has acceded jurisdiction by filing a general appeal de novo to the District Justice award. The Defendant is Plaintiff s daughter. Count I -Car Loan 6. Paragraphs one through five are incorporated herein by reference. During or around September of 1997, the parties jointlyborrowed approximately $5,100.00 from Jonestown Bank & Trust Company. 8. The loan was used to purchase a 1995 Mercury Sable automobile. The vehicle was titled in the Defendant's name. 10. The Defendant enjoyed the full use and privilege of operating the vehicle. 11. At the time of the transaction, the Defendant promised to make the payments to Jonestown Bank & Trust. 12. As part of the agreement, if Defendant was unable to make a given monthly payment, the Plaintiff would make the same, and Defendant was to reimburse the Plaintiff. 13. The Plaintiff has made payments upon the co-signed loan as they became due. 14. No term was specifically agreed upon within which Defendant was to repay the Plaintiff. 15. To date, the Defendant has not reimbursed the Plaintiff for any of the payments. 16. The reasonable period of time supplied by the Uniform Commercial Code as the repayment term for a note has passed without payment by the Defendant. WHEREFORE, demand is made, each in the alternative, for: a) Repayment of the $5,100.00 debt as promised and contracted for by the Defendant; b) Repayment of the $5,100.00 paid by virtue of the doctrines of quantum meruit or equitable trust for value received by the Defendant; or c) Repayment of the $2,550.00 debt representing one-half of the co-signed, joint and several obligation. Count II -Car Repairs 17. Paragraphs one through sixteen are incorporated herein by reference. 1$. During or around February 1998, the Defendant asked the Plainfiff to lend her money to repair the vehicle. 19. On or about February 5, 1998, the Plainfiff borrowed approximately $1,900.00 from Beneficial Consumer Discount Company. 20. The Plaintiff paid $1,899.52 to P.I.E. Transmission, Inc., of Harrisburg, Pennsylvania to perform repairs to the transmission of Defendant's vehicle. 21. The parties verbally agreed that the Defendant would repay the $1900, without interest, in the amount of $150.00 per month. 22. The payee of the repayments was to be either Beneficial or the Plaintiff, at the Defendant's option. 23. In the event the Defendant chose to repay the Plaintiff, there was no stipulation as to the repayment term. 24. To date, the Defendant has not reimbursed the Plaintiff for any of the payments. 25.
