PAUL CHERRY, Individually and Trading As CHERRY'S : CIVIL DIVISION -LAW CUSTOM TRUCK ACCESSORIES Defendant COMPLAINT The Plaintiff, VALLEY CHROME PLATING, INC., by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendant to recover the sum of FOUR THOUSAND, SIXTY DOLLARS ($4,060.00), along with interest thereon from March 30, 2001 upon a cause of action of which the following is a statement: 1. The Plaintiff, VALLEY CHROME PLATING, INC., is a corporation organized and existing under the laws of the State of California, having its principal office and place of business at P.O. Box 189, Clovis, CA 93613-0189. 2. The Defendant, PAUL CHERRY, is an adult individual trading and doing business as CHERRY'S CUSTOM TRUCK ACCESSORIES and has an office and place of business at 1161 Harrisburg Pike, Carlisle, PA 17013. 3. Defendant executed a Credit Application with Plaintiff, thereby requesting Plaintiff to extend credit to Defendant. A true and correct copy of the Credit Application is hereto attached, made a part hereof and marked Exhibit "A" 4. Defendant's Credit Application was subsequently approved and Plaintiff did extend credit to Defendant. 5. On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiffs books of original entry hereto attached, made a part hereof and marked Exhibit "B", Defendant became liable on certain invoices as set forth on said Exhibit "B" to the total amount of FOUR THOUSAND, SIXTY DOLLARS ($4,060.00). The balance due and owing by Defendant to Plaintiff is the sum of FOUR THOUSAND, SIXTY DOLLARS ($4,060.00), as appears by the Statement of Account hereto attached, made a part hereof and marked as Exhibit "B". Plaintiff has frequently demanded payment from Defendant of said amount due and owing as aforesaid, but Defendant has refused and neglected and still refuses and neglects to pay said amount of any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of FOUR THOUSAND, SIXTY DOLLARS ($4,060.00), together with interest thereon from March 20, 2001.
