WHEREAS, Shughart Custom Homes, Inc., of 3 East Linden Drive, Carlisle,
Cumberland County, Pennsylvania 17013, has executed a contract with Shughart Custom
Homes, Inc., of 3 East Linden Drive, Carlisle, Cumberland County, Pennsylvania 17013, for the
erection of a residential dwelling upon a tract of land situate in Dickinson Township,
Cumberland County, Pennsylvania, more particularly described in the deed of Linwood B.
Phillips, widower, dated July 2, 2001, and recorded in the Office of the Recorder of Deeds for
Cumberland County, Pennsylvania in Deed Book _, Page _, and being Lot 9, Subdivision
for Clarendon (Plan Book 77, Page 56), located on East Linden Drive, Carlisle, Pennsylvania
17013.
NOW, July 2, 2001, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owners to the said Contractor to
commence work on said building, or to purchase materials for the same in consideration of the
making of the said contract with the said Contractor and the further consideration of the sum of
One and no/100 ($1.00) Dollar to Contractor paid by said Owners, it is agreed that no lien shall
be filed against the building by the contractor, or any subcontractor, nor by any of the material
men or workmen or any other person for any labor or materials purchased or extra labor or
materials purchased for the erection of said building, the right to file such liens being expressly ,
waived.
