HADGE, of 671 Shannon Road, Boiling Springs, Pennsylvania, is about to execute contemporaneously herewith, a contract, with THOMAS CONSTRUCTION ASSOC., of 155 Ken-Lin Drive, Carlisle, Pennsylvania, for the construction of a dwelling located upon premises commonly known as Lots 3 & 4 Crystal Lake Estate, Hickorytown Road, Middlesex Township, Cumberland County, Pennsylvania, as set forth in the Deed dated February ~, 2001, at Deed Book ~35~`,"Page in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. x NOW, %i'<b /c/L . _, 2001, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollaz ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Tile proposed stormwater management faciliry and the embankments and water surface of the existing farm pond shall be maintained in existing or better condition by the individual prupem owners, on whose Vots these features are Socated. The maintenance will include keeping the water and the shoreline of the ponds reasonably free of debris and keeping the facilities and pond embankments in operating condition as per any applicable regulatory statutes or requirements. This includes Lots Nos. 4, 5, 6, 9 and 10. The proposed stormwatet detention facility shall also be kept in good laazt condition. 3. There shall be no grading, placement of fill, or other activity which will impede the Oow of stormwacer in the areas denoted as watercourses or ponding limits as shown on the aforesaid Plan.
