NOW, June 8, 2001 , at the time of and immediately before the execution of the prin-
cipal contract, and before any authority has been given by the said owner
to the said contractor
to commence work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Fogarty Homes Inc. and the further
consideration of One Dollar, to Fogarty Homes, Inc. paid
by Edward T. Hagerty & Linda A. Hagerty , it is agreed that no lien shall be filed against the
building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person (or any
labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such
liens being expressly waived.

ALL THAT CERTAIN tract or parcel of land situate in the Township of East
Pennsboro, County of Cumberland, Commonwealth of Pennsylvania, more particularly
bounded and described as follows, to wit:
BEGINNING at a point on the southern right-of-way line of Pagoda Court
Cul-De-Sac (100' wide) at the dividing line between Lots #23 and #24 as shown on
the hereinafter mentioned plan; thence along the right-of-way line of Pagoda
Court Cul-De-Sac by a curve, curving to the left in a northerly direction having
a radius of 50.00 feet and an arc length of 56.29' feet to a point at the
dividing line between Lots #24 and #25; thence along the dividing line between
Lots #24 and #25 North 80° 14' 45" East a distance of 100.00' feet to a point on
the western line of lands now or late of The Most Reverend Joseph T. Daley
Bishop of Harrisburg Diocese of The Catholic Church; thence along said lands
South 09° 45' 15" East a distance of 190.00' feet to a point at the dividing
line between lots #19 and #24; thence along the dividing line between lots #19
and #24 South 80° 19' 45" West a distance of 59.39' feet to a point at the
dividing line between lots #19, #23 and #24; thence along the dividing line
between lots #23 and #24 North 35° 15' 00" west a distance of 160.50' feet to a
point on the southern right-of-way line of Pagoda Court, said point being the
place of BEGINNING.
CONTAINING 18,485.24 S.F.
BEING Lot #29 as shown on the Final Subdivision Plan of Penn Valley, Phase 4,
recorded in Plan Book 82, Page 67.
BEING part of the same premises which Penn Valley Corp., a Pennsylvania
Corporation, by Indenture dated June 2, 1998 and recorded at Carlisle in the
County of Cumberland on June 2, 1998 in Deed Book 180, Page 263, granted and
conveyed unto Logan's Run Associates.
