MURPHY, ESQUIRE, and complains of the Defendants, HEODORE KALATHAS and THEO'S BAR AND GRILL, individually, jointly or ;verally, as follows: 1. The Plaintiff is U.S. Food Service, Inc., Pittston Division, a corporation my authorized to do business in the Commonwealth of Pennsylvania, with its rincipal place of business at 13 Rutledge Drive, P.O. Box 767, Pittston, Luzerne ounty, Pennsylvania. 2. The Defendant is Theodore Kalathas, an adult individual doing business 1838 Hummel Avenue, Camp Hill, Cumberland County, Pennsylvania. 3. The Defendant is Theo's Bar and Grill, a company duly authorized to duct business in the Commonwealth of Pennsylvania, with a principal place of iness located at 1833 Hummel Avenue, Camp Hill, Camp Hill, Cumberland inty, Pennsylvania. 4. At all times relevant hereto, the Defendants, individually, jointly or ally, were customers of the Plaintiff and purchased food products or food ;es from the Plaintiff on credit. 5. At all times relevant hereto, the Plaintiff was in the business of furnishing its customers food products and food services on credit, with the express or died understanding that the customer would pay for all products upon receipt. 6. The Defendants, individually, jointly or severally, entered into an ment wherein they agreed to pay all sums due as result of the sale of cts to them on credit. 7. From the period beginning March 28, 2000, and continuing through May 2000, the Defendants, individually, jointly or severally, ordered and received m the Plaintiff the food products and/or services itemized on the invoices ached hereto and made a part hereof as Exhibits "A" through "E": INVOICE TE #5756300 March 28, 2000 #5759527 April 4, 2000 #5762491 April 11, 2000 #5765601 April 18, 2000 #5772289 May 2, 2000 AMOUNT S 1,409.39 1,228.13 954.39 747.21 245.21 TOTAL S 4,584.33 8. As of the date of this Complaint, the Defendants, individually, jointly or ;verally, have made payments toward the above outstanding in the amount of Five undyed dollars, bringing Defendants' balance to Four Thousand Eighty-four Dollars 1d Thirty-three Cents (54,084.33), and have continued to refuse to bring this ;count current. 9. The Defendants, individually, jointly or severally, owe the Plaintiff the m of Four Thousand Eighty-four Dollars and Thirty-three Cents (54,084.33), the count which Plaintiff has demanded and continues to demand. C®UNTI Breach of Contract 10. Plaintiff incorporates herein by reference Paragraphs 1 through 9 11. The Defendants, individually, jointly or severally, have an agreement obligation to pay for the products received, as a result of an express contract the Plaintiff. 12. The Defendants, individually, jointly or severally, have materially ached their obligation with the Plaintiff, and have refused to pay the above cunt which is due and owing pursuant to the express agreement between the 13. As a result of the breach of contract by Defendants, individually, jointly severally, the Plaintiff has incurred damages in lost income in the amount of Four ousand Eighty-four Dollars and Thirty-three Cents (54,084.331, plus attorney's :s and costs. WHEREFORE, the Plaintiff requests this Honorable Court to enter Judgment n its favor and against the Defendants, individually, jointly or severally, in an amount less than Thirty Thousand. (530,000.00) Dollars. COUNT II Breach of Implied Contract 14. Plaintiff incorporates herein by reference Paragraphs 1 through 13 15. The Defendants, individually, jointly or severally, had an implied 'act in which they received products on credit with the understanding that they d pay the full amount due and owing to Plaintiff on the date set forth in each ce set forth in Exhibits "A" through "E". 16. The Defendants, individually, jointly or severally, breached their implied itract with the Plaintiff in that they accepted and used products pursuant to said died contract, but refused to pay the amount owed for those products itemized the invoices which accompanied each shipment. 17. As a result of Defendants' breach of implied contract, the Plaintiff ffered damages in lost income in the amount of Four Thousand Eighty-four Dollars d Thirty-three Cents (54,084.33), plus attorney's tees and costs. WHEREFORE, the Plaintiff requests this Honorable Court to enter Judgment its favor and against the Defendants, individually, jointly or severally, in an count less than Thirty Thousand (530,000.00) Dollars. COUNT III Quantum Meruit 18. Plaintiff incorporates herein by reference Paragraphs 1 through 17 nclusive. 19. The Defendants, individually, jointly or severally, were unjustly enriched ,y the Plaintiff in that they received products from the Plaintiff as indicated by the nvoices attached as Exhibits "A" through "E", and have refused to pay the fair narket value for said products. 20. The Defendants accepted each shipment of products from the Plaintiff Wowing that Plaintiff demanded payment for said products, and received in writing y way of invoices, Plaintiff's intentions to seek the fair market value for said roducts. 21. The Plaintiff would be severely prejudiced if it was not given fair isation for said products delivered to Defendants, the same being the fair value as charged on the invoices attached as Exhibits "A" through "E". 22. It would be inequitable to allow the Defendants, individually, jointly or ly, to receive value in the form of products without being required to fairly isate the Plaintiff for the value of the products received by Defendants.
