WHEREAS, Pro Logis Development Services Incorporated of 14100 East 35~' Place, Aurora,
Colorado 80011, is about to enter into a contract with R. S. Mowery & Sons, Inc., of Carlisle,
Pennsylvania, for the construction of a Distribution Center located on Lot #1 of the Final
Minor Subdivision Plan forWilliam N. Wenger and Louise R. H. Wengerand John G. Hatfield
and Mary Elizabeth Wenger Hatfield, South Middleton Township, Cumberland County,
Pennsylvania, recorded in Plan Book 82, Page 115.
NOW, July 11, 2001, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said ProLOgis
Development Services Incorporated to the said R. S. Mowery & Sons, Inc., to commence
work on the said building, or purchase materials for the same in consideration of the
making of the said contract with R. S. Mowery & Sons, Inc., and the further consideration
of One Dollar to R. S. Mowery & Sons, Inc., paid by Prologis Development Services
Incorporated, it is agreed that no lien shall be filed against the buildings or property by
the contractor, norany subcontractor, nor by any of the material men orworkmen norany
other person for any labor, or materials purchased, or extra labor or materials purchased
for the completion of said buildings, the right to file such liens being expressly waived.
