Andes, and makes the following complaint in this matter: 1. Plaintiff is Hartman & Associates, Inc. a Pennsylvania business corporation which maintains its primary offices at 2101 Orchard Road in Camp Hill, Pennsylvania. 2. The Defendant Scott Lee Davis is an adult individual who the Plaintiff believes resides at 117 Pleasant Street in Hanover, Pennsylvania. 3. The Defendants Nancy Kegerreis and Marc D'Amour are adult individuals who, to Plaintiff's knowledge work at and maybe served at the Thoroughbred Tavern an the Old Jonestown Road, RD 1, Grantville, Pennsylvania. 4. Plaintiff has been, at all times relevant to this action, engaged in the business of civil engineering surveying. 5. In 1998, Defendants Kegerreis and D'Amour owned property in East Hanover Township, Dauphin County and Lebanon County, Pennsylvania and had agreed to sell and convey a portion of that property to Defendant Davis. b. In order to complete the transfer of property contemplated by the Defendants, they required a subdivision plan approved by the municipalities in which the land was situated. 7. In 1998, the Defendants engaged Plaintiff to do engineering and survey work as required to obtain the necessary municipal approvals for the subdivision and transfer of their property. 8. In reliance upon the agreement between Plaintiff and Defendants and in accordance with instructions received by Plaintiff from the Defendants, the Plaintiff did extensive survey and engineering work for Defendants to obtain the necessary approvals for the subdivision and conveyance of the property as the Defendants wanted. The work done by Plaintiff is described in invoices issued by Plaintiff, copies of which are attached hereto and marked as Exhibit A and are incorporated herein by reference. 9. The fees and costs charged by Plaintiff to Defendants for the work Plaintiff did are accurately listed on the invoices attached hereto and marked as Exhibit A. Such fees and charges are Plaintiff's normal fees and changes for such work, are normal, typical, and reasonable charges for such services in the time and place those services were rendered and are the fees which the Defendants agree to pay and the benefit of which they accepted. 10. The total charged by Plaintiff for its work for Defendants was $8,730.28, as shown on Exhibit A. To date, Defendants have paid $3,000.00 for those services and currently owe a balance of $5,738.26 plus interest from and after 14 July 1999. COUNT I -CONTRACT 11. The averments set forth in paragraph 1 through 10 are incorporated hereby by reference. 12. Plaintiff and Defendant formed a contract whereby Defendants agreed to pay Plaintiff for the work Plaintiff performed for Defendants. 13. Plaintiff well and truly performed its obligations under that contract and is entitled to payment for its services. 14. Pursuant to the contract between the parties, Defendants owe Plaintiff, $5,738.26 plus interest from and after 14 July 1999. WHEREFORE, Plaintiff demands judgment against Defendant in the amount of $5,738.26, plus interest from and after 14 July 1999, plus costs of suit. COUNT II -UNJUST ENRICHMENT 15. The averments set forth in paragraph 1 through 14 are incorporated hereby by reference. 16. The work done by Plaintiff was done at the direction and for the benefits of the Defendants. 17. Plaintiff's work for Defendants benefitted them and conferred a benefit upon them. 18. Defendants accepted the benefit of Plaintiff's work. 19. Defendants have been unjustly enriched by Plaintiff's work,, for which Defendants have not paid. 20. The reasonable value of the benefit which Plaintiff has conferred upon Defendants is $5,738.26. Admitted that there are fees and costs charged by Plaintiff, but it is specifically denied that the answering Defendants are responsible for any charges incurred by the Plaintiff or any subdivision work. 10.
